한국 피해자보호와 지원의 회고

Retrospective on the Protection and Support of Victims in Korea

한국피해해자학회가 30주년을 맞이하였다. 보통 우리는 30년 정도의 기간을 한 세대(世 代)라는 이름으로 매듭을 짓는다. 그 한 세대 동안 성장하여 이제 어른이 된 한국피해자학회를 기념하고, 더욱 성숙한 다음 세대로 나가기 위해, 우리는 ‘회고와 전망’이란 화두를 가지고 모였다. 과거를 되돌아보고(회고), 새로움을 찾자는 자리라 하겠다(전망). 그러한 뜻깊은 자리에 ‘회고’의 부탁을 받았다. 겸양지덕(謙讓之德)이라 했다. 사양해야했고 양보해야 했다. 더욱이 능력이 따르지 않기에 겸손해야 했다. 그러나 한국피해자학회30주년 기념 국제학술회의 기조 강연에 학회 창립자의 순서가 있다는 말에 마냥 거절만 할수 없었다. 그래서 그저 회고(回顧)의 의미대로 ‘지난 일을 되짚어 보면 되겠지’라는 생각으로 이 자리에 앉게 되었다. ‘만용’이란 것 잘 안다. 이런저런 이유로 엄격한 논문의 형식이아닌 편한 글로써 ‘한국 피해자 보호와 지원’의 회고를 정리하고자 한다. 이 글은 먼저 피해자 보호와 지원체계를 개관하고 검토하고자 한다(II). 본질에서 형사사법기관의 업무는 범죄 수사, 재판, 형의 집행이다. 국가형벌권의 작용이며, 그 속에는 오랫동안 범죄자(가해자)가 관심의 대상이었다. 그러나 범죄 해결에는 피해자도 중요하다는 인식이싹트고 서서히, 어쩌면 우연히 피해자 쪽으로 관심을 가지면서 형사절차를 비롯하여 전반적인 사법제도에 피해자의 지위가 논해지기 시작했다. 문제는 오랫동안 수사를 하면서 생긴 고착된 범죄자에 관한 인식을 가지고 피해자를 생각하기는 쉽지 않다. 그래서 피해자 관점의사고와 논리를 정리하는 것이 중요하다(III). 마지막으로 되돌아봄(회고)을 정리한다(IV).

This article is a paper presented at an academic conference held by the Korean Association of Victimology under the theme of ‘Retrospective and Prospects’ to mark the 30th anniversary. This article first outlines and reviews the victim protection and support system (II). In essence, the tasks of criminal justice agencies are criminal investigation, trial, and execution of sentences. It is the action of the right to punish the state, and criminals have long been the subject of attention. However, the perception that victims are also important in solving crimes began to emerge and gradually, perhaps accidentally, interested in victims began to discuss the status of victims in the overall judicial system, including criminal proceedings. The problem is that it is not easy to think of the victim with the perception of the fixed criminal that has occurred during the long investigation. Therefore, it is important to organize the thinking and logic of the victim's point of view (III). Finally, the reflection (review) is summarized (IV).
