자사고ㆍ외고ㆍ국제고 등 고교유형 개편의쟁점 및 과제 분석

Reorganization of High School Types: Analysis of Current Issues and Legislative･Policy Measures

이 연구에서는 자사고 및 외고ㆍ국제고의 도입 목적, 현황, 개편 정책 등을 분석하여 정책적ㆍ법적 개선 과제를 제시하였다. 2020년 2월 28일 ｢초ㆍ중등교육법 시행령｣ 개정에 따라 2025년 3월 1일부터 모든 자사고 및 외고ㆍ국제고는 일반고로 전환될 예정이다. 이에 대해서는 자사고의 단기간 급증 및 특정 지역 편중, 전체 특목고ㆍ영재학교 및 자율고 등의 일반고 대비 비율 과다, 자사고와 외고ㆍ국제고의 지정 목적 부합 여부, 고등학교 유형의 정책적ㆍ법적 안정성 및 국민 의견 수렴 미흡 등이 문제라고 인식되었다. 이를 개선하기 위한 방안으로 지정 목적에 부합하지 않는 외고 등의 일반고 전환, 자사고 유지 시 특정지역 편중 해소 및 법인전입금 의무비율 상향, 고교 유형의 법률적 근거 마련을 통한 안정적 제도화, 고교 교육의 수월성과 평등성을 함께 제고할 수 있는 고교 유형 개편 필요 등을 제안하였다.

This study analyzes the purpose of autonomous private, foreign language & international high schools, current status, and related policies and laws. Based on the analysis, legislative and policy measures for improvement are suggested. According to the amendment of the “Enforcement Decree of the Elementary and Secondary Education Act” on February 28, 2020, all autonomous private, foreign language & international high schools will be converted to general high schools from March 1, 2025. The main issues are as follows: (A) Short-term increase in autonomous private high schools and concentration in specific regions; (B) Excessive ratio of special purpose & gifted high schools and autonomous high schools compared to general high schools; (C) Whether autonomous private, foreign language & international high schools meet the purpose of designation; and (D) Political and legal stability issues of the high school type and insufficient public opinion collection. As a result, we propose the following legislative and policy measures to address the issues identified above. First, foreign language high schools that do not meet the purpose of designation need to be converted to general high schools. Second, if the autonomous private high schools system is maintained, it is necessary to resolve the concentration in a specific region and increase the mandatory ratio of legal contributions of school juristic persons. Third, the types of high school need to be regulated by law to enhance legal stability. Fourth, it is necessary to reorganize the types of high schools that can improve both excellence and equality in education.
