국제인권레짐과 북한인권문제 간의 상관성에 관한 연구

A Study on the Interrelationship of International Human Right's Regime and North Korean Human Right's Problem

본 논문은 국제인권레짐과 북한인권문제 간의 상관성을 분석하고 있다. 이 주제를 구체적으로 분석하기 위해서는 무엇보다도 기본적인 인식이 요청되는데, 첫째, 인권의 절대성에 대한 확고한 믿음체계가 필요하고 둘째, 북한체제에 대한 객관적인 비판의식이 요청되고 마지막으로 보편적 가치에 대한 믿음이 필요하다. 이러한 기본인식을 기초로 하여 국제인권레짐과 북한인권문제 간의 상관성을 도출하면 다음과 같다. 비록 국제인권레짐은 하나의 구체적이고 실효적인 조직체를 지니고 있는 것은 아니지만 탈냉전 후 세계가 자유화와 민주화가 보다 진척됨에 따라 그 영향력은 증대되고 있는 실정이다. 이러한 상황에서 북한인권문제는 국제인권레짐의 하위단위로서의 의미가 확고하게 자리잡고 있음을 알 수 있다. 다음으로 이제 북한인권문제는 북한이라는 나라의 개별국가의 특수한 문제가 아니라 세계의 평화질서를 위협하는 대표적인 국제문제로 자리잡고 있다. 이런 상황에서 국제인권레짐은 북한인권문제에 대한 하나의 규율자로서의 역할과 의미가 분명히 증대되고 있다고 하겠다. 마지막으로 국제인권레짐의 수많은 현안과제 내지 해결과제 중 북한인권문제는 반드시 풀어야 할 긴급현안으로 인식되고 있다는 점이다. 이런 점에서 북한인권문제는 전세계 초미의 과제로 급부상하고 있다.

This study is aimed to analyse the interrelationship of the regime of international human right and the problem of North Korean human right. To analyse concretely this subject is requested a basic recognition. First, it is keenly necessary to have the belief system about the absolutism of human right. Secondly, the critical consciousness on the North Korean regime is needed. Finally, it is necessary to keep the belief about a universal values. Working upon this basic recognition, the interrelationship of the regime of international human right and the problem of North Korean human right is as follows. Although a international human right's regime hasn't a concrete and effective organic body, it's influence is increased after the post-cold war. With this situation, I think that the problem of North Korean human right is a sub-unit of the regime of international human right. In the second place, the problem of North Korean human right is not a individual nation's problem but a representative international issue threating of a world peace. In this situation, the regime of international human right is increasing the influence on the problem of North Korean human right. Finally, the problem of North Korean human right is recognized as the urgent issue in the regime of international human right.
