소크라테스를 어떻게 가르칠 것인가? 사회과 법교육을 중심으로

인간사회에 법치주의가 필요한 이유는 다수결의 한계 때문이며, 다수결이 한계를 가지는 이유는 인간의 이성이 완전하게 합리적이지는 못하기 때문이다. 대부분의 초중고 교과서에서 법치주의를 서술함에 있어서 다수결의 한계 때문에 법치주의가 필요하다거나, 소수자를 보호하기 위해 법치주의가 필요하다는 진술을 찾아보기가 쉽지 않다. 고등학교 선택과목‘법과 정치’ 과목에 이르러서야 실질적 법치주의와 형식적 법치주의를 구별하여 가르치는 정도이다. 인간사회에 법치주의가 필요한 이유는 인간의 합리성에는 한계가 있기 때문이며, 민주주의에서 다수결의 한계를 보완하기 위해, 또한 소수자 보호를 위해 법치주의가 필요하다는 점을 명백히 가르칠 필요가 있다. 이러한 점에 비추어 소크라테스를 초·중·고등학교에서 가르침에 있어서 소크라테스가 사형을 당하고 이로 인해 플라톤이 철인정치를 주장하게 된 과정이 현대사회에 실질적 법치주의가 뿌리 내리게 된 과정과 유사함을 상기시켜, 소크라테스를 현대의 실질적 법치주의와 연결하여 가르칠 필요가 있다.

In describing the rule of law in most elementary, middle and high school textbooks, it is not easy to find a statement that the rule of law is necessary due to the limitations of majority voting, or that the rule of law is necessary to protect minorities. It is the level of distinguishing and teaching practical constitutionalism and formal constitutionalism in the high school elective subject 'law and politics' when such concepts are introduced. The reason why the rule of law is necessary in human society is that there is a limit to human rationality, and it is necessary to clearly teach that the rule of law is necessary to protect minorities in order to supplement the limitations of majority voting in democracy.
