외국의 법무보호복지(갱생보호)제도의 현황 - 특히, 영국과 캐나다를 중심으로 -

Current Status of the Foreign Legal Protection Welfare (Rehabilitation) Policy - With Particular Focus on England and Canada -

발전된 국가의 위상에 걸맞게 갱생보호 분야도 획기적으로 개선하여 국민들로부터 긍정적인 평가를 받고 있는 것도 사실이다. 그러나 아직까지도 그 관리가 효율적이고 체계적으로 이루어지지 못하고 아직도 개선되어야 할 점이 적지 않다. 일찍부터 유럽 등 선진 외국에서는 갱생분야의 중요성을 인식하고 다양한 연구접근을 통해 보다 바람직한 기준을 마련하여 이를 실무에 반영하는 등 관리에 심혈을 기울이고 있음은 주지의 사실이다. 특히 영국이나 캐나다는 보호관찰분야및 형기를 마치고 출소하여 모범적인 사회인으로 정착할 수 있도록 돕는 갱생보호 분야에 많은 국가적 지원을 아끼지 않고 있다. 최근 범죄예방정책과 관련하여범죄예방분야에 대한 제도 및 정보교류 등을 주요내용으로 하는 최초로 선진적인제도를 가지고 있는 캐나다와 2011.6. MOU를 체결한 것은 그런 점에서 의미가있다고 본다. 그리고 범죄예방역량 결집을 통한 범죄예방의 효율성 제고를 위해서는 출소자 개인은 물론, 그 가족 및 지역사회의 관계회복을 위해 가족지원까지확대하며 가정복원사업에 정부의 적극적이고 추가적인 지원을 아끼지 말아야 한다.

It is true that developed countries have innovatively improved the rehabilitation field to suit the status of their country to receive a positive evaluation from their nation. However, there still are many areas that require improvement that have not yet been efficiently and systematically been managed. From an early stage, advanced countries, such as European countries, recognized the importance of rehabilitation and have devoted interest and commitment into managing the field, such as preparing a preferable standard through various research approaches to reflect the findings in the field. Particularly in England and Canada, national support is not spared on many areas of rehabilitation to help one to settle as a model citizen after completing his probation and sentence, and being released. The conclusion of the recent MOU with Canada in June 2011 being the first country to have an advanced policy providing the main contents, such as information exchange and policy related to the field or crime prevention in relation to crime prevention policies is significant in this regard. Furthermore, in order to promote the efficiency of crime prevention through the concentration of the capacity of crime prevention, the government's active and additional support should not be spared for the family support for the recovery of relationship with the family and regional society of the suitor, and family recovery projects, in addition to the suitor himself.
