고령화사회에 있어서 노인범죄

The Present State and Countermeasure of Elderly Crime in Korea

21세기 들어서자 말자 우리는 고령화사회에 내키지 않지만 와 있다. 저 출산으로인한 것이고 돌이켜 보면 그 저출산은 산업화와 이기주의 과도한 경쟁에 물질위주의정신적 가치 빈약으로 전통사회를 넘어뜨리고 참을 줄 모르고 내 편리만 추구하는우리들이 자초한 것이기에 감당해야 하는 것도 대책을 세우는 것도 우리들의 몫이다. 형사사법적 관점에서 고령화사회의 가장 절박한 상황은 범죄의 무대에 노인들이 주인공처럼 등장하기 시작했다는 점이다. 나이 60이면 귀가 술술 열리고 70이면마음 가는 대로 해도 도에 어긋나지 않는다고 한 것이 노인이다. 자고로 인자하고관용을 베풀며 언 감홍시를 아랫목에 녹였다가 손자 입에 넣어주는 인심 좋은 사람으로 우리들 마음 속에 있는 이가 노인이다. 그런데 무엇이 이토록 무섭게 노인을변하도록 했는가? 이에 대한 의문과 의문에 대한 해답을 제시하여 노인들을 범죄의무대로부터 내려 앉히고 다시 인심 좋은 노인으로 돌려보내기 위해 방안을 찾아본것이 이 논문의 내용이다.

In the year 2000, Korea became an aging society, with 7% of its population being comprised of elderly citizens over 65 years old from among the whole population. Now elderly crimes occupies 2.0% of total crimes 1n the year 2007, as time passes, crimes committed by elderly is on the increase rapidly. however, efforts to reduce the crimes or to take proper countermeasure to prevent elderly crime is not sufficient. Therefore the purpose of this study is to find a solution of elderly crime. the heart of elderly crime is on the alienation, indigence, fading of community spirit from appearance of individualistic thought, and loss of social role. That is to say elderly crime is caused by these. Therefore, the authorities should make all efforts to provide work for elderly citizen and to give economic support. The authorities and communities must show more interest to elderly citizen, develop leisure programs for the elderly citizen, and increase voluntary service activities. In view of social welfare we should gain access to elderly crimes. These is the best way to reduce elderly crime. In the last, elderly inmates have several characteristics of weak physical condition. Therefore special steps is needed. Namely introduction of program only for the elderly inmates, installation in a correction institution exclusively for the elderly inmates and reinforcement in professional medical treatment are special action.
