보안처분제도의 정비방안에 관한 연구

A Study on the Improvement of Security Disposal System

형벌은 범죄자의 과거 범죄에 대한 책임을 근거로 처벌하지만, 보안처분은 범죄자의 장래 위험성에 기초한 범죄의 예방이라는 점에서 형벌과 비교되며, 형법전에명문규정은 없지만 이원주의를 취하고 있다. 이러한 보안처분이 지향하는 목표는 범죄자를 개선하여 사회로의 원활한 복귀는 돕는 것이다. 특히 우리나라의 경우 2005년 8월 사회보호법이 폐지되고 치료감호에 대한 필요성이 인정되어 별도의 치료감호법을 제정하여 지금까지 왔다. 보호감호제도의 폐지이후 성폭력범죄 및 연쇄살인 등 강력범죄가 증가하고 있는 현실에서 다양한 형사제재가 도입되었다. 이처럼 보안처분적 성격을 갖는 형사제재가 무분별하게 도입되고있는 현실하에 보안처분의 집행이 이중처벌 및 과잉처벌이 되지 않도록 그에 따른정비가 시급한 것으로 보인다. 보안처분의 시행에 있어서 그동안의 자유박탈적 보안처분과 자유제한 보안적 보안처분에서 탈피하여 범죄 및 범죄자의 특성과 유형에 따른 차별화되고 다양한 맞춤형 보안처분의 도입을 현실화 하여야 할 것이다. 이로 인해 그들에 대한 장래 재범위험성을 감소시키고, 빠르고 원활하게 사회에 복귀할 수 있도록 도와야 할 것이다.

Punishment is carried out on the basis of a criminal's responsibility for the past crime. But a security measure is compared with punishment in a regard of being the prevention of a crime based on an offender's future riskiness, and is taking dualism even if there is no substantive enactment in the penal code. The objective to which this security measure points is what is helpful for a smooth return to society through improving a criminal. Especially in case of our country, the necessity of medical treatment and custody was recognized while the Social Protection Act was abolished in August of 2005. Thus, the special Medical Treatment and Custody Act was enacted and has been continued so far. In the reality of being grown violent crimes such as sexual violence crime and serial murders following the abolishment of the protective custody system, various criminal sanctions were introduced. Under the reality of being indiscreetly adopted criminal sanctions that have a security-measure characteristic in this way, the modification according to it seems to be imminent so that the execution of a security measure cannot be the double punishment and the excessive punishment. The enforcement in a security measure will need to be actualized the introduction of differentiated & various customized security measures depending on a characteristic and a type in a crime and an offender, escaping from the freedom-deprivation security measure and the limited-freedom security measure in the meantime. This will need to lead to helping them with reducing the future recidivism risk and with possibly returning to society quickly and smoothly.
