취업조건부 가석방제도 도입의 의의와 법무보호사업의 지평

취업조건부 가석방제도가 활성화되는가 하는 문제는 법무보호사업이 적극적이냐하는 문제에 맞닿아 있다. 출소자 대상의 법무보호사업은 출소자가 자활을 위하여의무적으로 받아야 하는 것은 아니다. 이 점 법무보호사업을 통한 재범방지를 소극적으로 하게 하는 한계라고 할 수 있다. 그러나 취업조건부 가석방 출소자의 법무보호사업은 적극적일 수 있다. 취업조건부 가석방도 출소자의 동의를 전제로 이루어진다는 점에서 기존의 법무보호대상자와 동일하지만 취업조건부 가석방 출소자에게는취업기간유지가 강제된다는 점에서 기존의 법무보호대상자와는 구별된다. 그런 범위에서 취업조건부 가석방 출소자에게는 더 적극적 더 안정적인 법무보호서비스 제공이 가능해진다고 할 수 있다. 이것이 법무보호사업의 지평을 넓히는 지점이다.

Nowadays the trend of correction treatment head forward community treatment. in order to overcome the limits of institutional treatment. parole system was adopted as a criminal policy. This article studied the aspects of the theory as well as the reality of the current parole which has been administered. and then the result of this study is that the current parole system in Korea has been carried out in a very passive fashion. generally the final goal of the correction treatment is rehabilitation. under the prison overcrowding Parole is very useful for this goal.especially parole on employment conditions is very very useful for this goal. Therefore in this view, the goal of this article is to propose a plan for enlargement of parole system under the supervision of mandatory probation. In the long run the most important point is to realize that parole is not a favor given by the authorities. not a reduced term of imprisonment but rather a new type of correction treatment for rehabilitation converted from institutional treatment into community treatment. And protection service by Korea rehabilitation Agency heads forward parole on employment is expected especially.
