사회봉사명령과 사회복지사의 역할

Social service orders and the role of social workers

사회봉사명령은 유죄가 확정된 범죄자 또는 소년범에 대하여 시설에 구금하지 않고 사회내에서 사회생활을 영위하면서 보수를 받지 않고 일정한 기간 내에지정된 시간을 공익적 활동(노동)에 종사할 것을 명하는 것을 말한다. 즉, 교도소에 구금하는 대신 정상적인 생활을 하면서 사회에 유익한 봉사를 하도록 명하는 제도이다. 사회봉사명령은 1970년 영국에서 교도소 과밀수용의 주요 원인인단기 구금형을 대체할 수단으로 제안되었으며, 이후 이 제도의 효과가 인정되어확대시행 되고 있다. 현재 많은 국가가 도입하고 있으며, 우리나라는 보호관찰제도와 함께 시행하고 있다. 사회복지사는 지역사회복지 실천현장에서 다양한 개인들과 집단을 대상으로활동하며, 지속적으로 변화하는 지역주민들의 욕구에 따라 과제를 수행하며 다양한 역할을 수행한다. 사회봉사명령은 교도소 수용 시 예상되는 악폐감염과 가정· 학교·직장 등 사회와의 단절을 방지하고, 체계적이고 전문적인 지도 감독을 통해효과적인 재범을 방지하는 것이 목적이다. 사회 각계각층이 범죄자 처우에 함께참여함으로써 공동체 의식을 강화할 수 있는 효과도 있다. 또한, 교도소 수용 등에 따른 예산비용을 절감할 수 있는 경제적인 효과도 기대된다. 이러한 점에서볼 때 범죄예방을 위한 사회복지사의 역할은 다양한 분야에서 요구된다. 즉 사회복지사는 사회봉사명령을 받은 자에 대해 전문적인 교육과 더불어 세심한 관심이 요구된다.

The Social Service Order is an advanced criminal policy that was introduced in Korea with the implementation of protection observations in July 1989. It is a system that allows criminals to repent of their crimes while volunteering at social welfare facilities for a certain period of time. From July 1989 when the social service order system was first implemented to the end of last year, there were 54,7,014 people who were ordered social service in the country and performed volunteer activities. Currently, more than 4,700 volunteers from 51 probation stations across the country are under the guidance and supervision of probation officers, and are implementing social service orders at over 730 designated locations. Criminals are members of our society to live with, not to be excluded. In particular, active distress and consideration for those who have been ordered to serve the society is closely related to the safety of our society. The social worker is in charge of a job that has a direct connection to the guidance and well-being of those who have been given social service orders. Therefore, this paper intends to discuss the role of social workers for those who have been ordered to serve.
