제주특별자치도의 재정상 분권 실현을 위한 법적 조치와 그 검토

Legal Study for Realizing Fiscal Decentralization of Jeju Special Self－Governing Province

제주특별자치도는 우리나라 최초의 차등분권을 목표로 한 지방자치단체다. 최초의 취지는 제주에서만큼은 연방제 국가에 버금가는 자치분권을 실현하는 것이었다. 지방자치법적으로는 보충성의 원칙을 철저히 실현하는 것으로 환언할 수 있다. 이를 법제도적으로 뒷받침하기 위해 제주특별법에는 구체적인 국가의 책무와 재정지원에 관한 규정이 있으나, 국가의 적극적 실천을 위한 의지가 크지 않은 것으로 보이며 또한 다른 지방자치단체와의 형평성 문제로 인해 쉽게 실현되지 못하는 측면이 있다. 다만 처음으로 특별자치를 시도하여 다양한 실제적 제도들을 시험하는 테스트 베드Test Bed로서의 역할은 그 자체로 의미를 가지는 바, 최근 강원도를 비롯한 차등분권적 지위를 가지는 지방자치단체가 많이 나타났기 때문이다. 한편 다른 특례 자치단체 예컨대, 세종특별자치시, 강원특별자치도, 부울경 메가시티(부산울산경남특별연합), 수원, 고양, 용인, 창원 특례시 등 이미 특례적 지위 또는 차등화된 분권을 제도적으로 인정받았거나 지향하고자 하는 논의들이 이루어지고 있는 바, 이와 같은 제주에 부여된 재정상 다양한 분권 및 특례적 조치들이 제대로 작동되는지 아니면 그 적정성이 인정되는지의 여부에 대한 법적 평가는 그 자체로 의미를 가지며, 또 다른 한편 제주의 재정상 특례는 차등분권을 지향하는 다양한 자치단체에 대한 제도적 테스트 베드로서 의미를 가진다고 평가될 수 있다.

Jeju Special Self－Governing Province is Korea's first local government aimed at differential decentralization. The first purpose was to realize autonomous decentralization comparable to that of a federal state in Jeju. In terms of local autonomy law, it can be said that the principle of supplementation is thoroughly realized. In order to support this legally and systematically, the Jeju Special Act stipulates specific state responsibilities and financial support, but it does not seem to be willing to actively implement the state, and it is not easily realized due to equity issues with other local governments. However, the role of a test bed as a test bed that tests various practical systems by attempting special autonomy for the first time is meaningful in itself, because many local governments with differential decentralization status, including Gangwon－do, have recently emerged. Other special municipalities, such as Sejong City, Gangwon Province, Buulgyeong Mega City, Suwon, Goyang, Yongin, and Changwon, have already been systematically recognized or discussed to seek differentiated decentralization.
