이른바 ‘검수완박’에 대한 비판적 검토와 법무보호복지의 지평

검찰개혁이라는 이름으로 지난 70여 년 간 쌓아온 검찰의 수사역량을 채 한달도 걸리지 않아 무너뜨렸다. 진정한 검찰개혁은 힘 있는 자에게도 똑같은 법집행이 이루어지고 정파에 상관없이 엄정히 법집행하는 검찰을 만드는 것이지 수사권 완전박탈이 아니다. 수사권을 박탈한다면 수사지휘권을 주든가 전건송치를하게 하든가 그것도 박탈한 마당에 경찰에게 기소권자 역할까지 하게 하면서 경찰에 대한 사법적 통제장치까지 치워버렸다. 사실 국민으로부터 위임받은 검찰권을 자의적으로 행사하는 걸 막아야 한다는 요청이 있다면 국민이 위임한 입법권 역시 자의적으로 행사하는 걸 막아야하는 요청이 생긴다. 이번 검수완박은 절차도 잘못되고 내용도 잘못된 국회의 입법권을 오남용한 사례로 역사에 불멸될 것이다. 그리고 이대로의 검수완박은 성공하기 어려울 것이다. 명분이 어떻든 순수하지 못한 동기에서 출발한 것이라 믿기 때문이다. 피해자 양산하는 입법이 검수완박이라면 범죄자를 줄이는 건 법무보호복지다. 범죄자 지원이 ‘곧 죄는 미워도 죄인은 미워하지 마라’는 법언의 실천적 액션이다. 검수완박에 암장되는 범죄자를 발굴하여 법무보호복지의 영역으로 끌고 오는것이 재범에 의한 추가적 피해자를 줄이는 일이고 이것이 곧 공동체의 행복 평수를 넓히는 일이고 법무보호복지의 지평을 넓히는 길이다.

Inorder to protect the freedom and right of people, the power of Korean prosecutor must be restricted in rational range on the principle of check and balance. Therefore, investigations(cognitive investigations) to crimes directly related to the six major crimes, police officers’ crimes. The major problem of the Korean prosecutors is Because of the direct investigation of the prosecution, which has lost political neutrality. All cases which police investigated have to be sent to prosecutor to control the powerful power of the police and to protect the freedom and right of people. Reform of the prosecution to completely separate investigations and prosecutions should be given up to protect the 99% of the criminal affairs cases that have been well implemented without any problems.There, independence and political neutrality of the prosecutor must be guaranteed. If Prosecution reform is necessary, the goal of the prosecution reform should be to ensure that the prosecution is no longer the “maid of the regime,” but contributes to the human rights of the people through objective and fair investigation.
