보호수용 조건부 가석방 대상자 사회정착지원 방안 연구

Measures to support social resettlement for those subject to secured custody and conditional parole: Focused on Rehabilitation of suitor

최근 한 아동 성폭력 대상자의 출소를 앞두고 전국이 떠들썩하며 국민의 공포감이 고조된 바 있다. 이와 같은 흉악범죄에 대응책으로써 정부는 ‘보호수용조건부 가석방제’를 국정과제로 선정하여 도입·추진하고 있다. 본 저자는 계획수립 단계에서의 제도 보완 및 전문가 의견 수렴 등을 목적으로 본 글을 작성하였다. 보호수용 조건부 가석방제는 말 그대로 가석방이기 때문에 형기종료자에대한 보호수용과는 구분된 개념이다. 보호수용 조건부 가석방자에게는 원칙적으로 전자장치를 부착하고 24시간 위치추적센터에서 관제한다. 또한 이들에게는 보호관찰 준수사항으로 일정 시간대 주거 및 외출 제한이 부과된다. 공단은 보호수용 조건부 가석방자의 사회정착 지원을 위한 전담 생활관 운영을 계획하고 있다. 전담 생활관은 기존 공단의 숙식제공 업무와 달리 가석방 입소자에 대한 강화된 외출관리와 체계적인 법무보호사업 지원이 그 특징이다. 직업훈련과 심리상담 지원을 중심으로 대상자가 취업성공에 이르기까지 지속적으로 관리한다. 그러나 보호수용 조건부 가석방제는 아직 초기 계획 단계이며 향후 추진 과정에서여전히 변동 가능성이 많다. 또한 최근 아동 성폭행범 김OO의 사례에 비춰볼때, 상당한 지역사회의 민원이 예상되는 바 성공적인 제도 안착까지는 많은 당면과제들을 해결해 나가야 할 것이다.

Recently, ahead of the release of child rapist, it caused a flutter across the country and heightened the public's fear. As a countermeasure against such heinous crimes, the government has selected and introduced and implemented the “Secured Custody and Conditional Parole System”. As the author, I wrote this article for the purpose of supplementing the system and collecting expert opinions in the stage of planning. Since the “Secured Custody and Conditional Parole System” is a parole as it is meant to be, it is a concept distinct from secured custody for those who have completed the sentence. In principle, the secured custody and conditional paroleers shall wear the electronic device and monitored through a 24-hour monitoring center. In addition, they are subject to restrictions on residence and going out for a certain period of time in accordance with the probation compliance regulations. Korea Rehabilitation Agency is planning to operate an exclusive dormitory to support social resettlement of the secured custody and conditional parolees. The exclusive dormitory is characterized with the enhanced outing management and systematic support of judicial protection work for parole entrants, unlike the existing board and lodging services provided by the public agency. This continues to manage the subjects achieves employment success, focusing on vocational training and psychological counseling support. However, the “Secured Custody and Conditional Parole System” is still in the initial planning stage and there is still a high possibility of change in the future implementation process.
