의약품의 허가 외 사용 관리체계 개선방안 고찰

A Study on the Improvement of Off-Label Drug Use Management System

규제당국으로부터 의약품에 대한 적응증, 연령, 용량, 투여경로 등에 대한 허가를 받았으나그 중 어느 하나라도 허가사항에 기재되어 있지 않은 용도로 사용되는 경우를 의약품의 허가 외사용 또는 오프라벨 사용(off-label use)이라고 일컫는다. 이러한 의약품의 허가 외 사용은 적응증 및 용량 결정에 대한 임상시험이 어려운 소아, 노인, 암환자 등 취약한 상황의 환자들에게 종종 이용되고 있다. 의약품의 적절한 허가 외 사용은 환자의 치료받을 권리의 확대를 가져오고, 체계적인 모니터링을 통해 허가 외 사용 의약품의 현황 파악과 더불어 의약품 사용의 안정성도 확보할 수 있다. 그러나 현재 우리나라 의약품의 허가 외 사용은 요양급여 대상과 비급여대상, 일반 약제와 항암제에 대한 사용 절차가 각각 다르게 되어 있어 의약품의 허가 외 사용에 대해 일관되고 체계적인 안전관리가 이루어지지 않고 있다는 비판을 피할 수 없다. 따라서 이 글에서는 의약품 허가 외 사용의 개념과 특성, 현재 국내 관리체계 현황과 문제점을 검토한 뒤, 의약품의 허가 외 사용에 대한 종합적 관리체계 구축을 위한 국가적 차원의 지침 마련과 함께 전문가집단의의사결정 절차 마련, 환자의 실질적인 자기결정권 보호 절차 마련의 필요성에 대해 주장하고자한다.

When a drug has been approved by the regulatory authorities for indications, ages, doses, and routes of administration, but any of them is used for purposes not listed in the permit, it is referred to as off-label drug use. The off-label drug use is often used for patients in vulnerable situations, such as children, the elderly, and cancer patients, who have difficulty in clinical trials for indication and dose determination. Appropriate off-label drug use can lead to the expansion of patients’ right to treatment, and systematic monitoring can help identify the current status of drugs used outside the license and ensure the stability of drug use. However, criticism cannot be avoided that there is no consistent and systematic safety management for off-label drug use in Korea because the procedures for off-label drug use of benefits and non-benefit drugs, general drugs and anticancer drugs are different. Therefore, after reviewing the concept and characteristics of off-label drug use, and the current status and problems of the domestic management system, I would like to argue the necessity of preparing decision-making procedures for expert groups and protecting patients’ right to self-determination.
