The Changes in the Concept of Society Regulated by Law: In case of civil law

흔히 법은 사회를 규율하는 규범체계로 이해된다. 하지만 이때 말하는 사회가 정확하게 무엇을 뜻하는지가 반드시 명확한 것은 아니다. 사회는 그 의미가 포괄적일 뿐만 아니라 다원적이기 때문이다. 이로 인해 어떤 관점에서 사회를 이해하는가에 따라 사회의 의미는 달라진다. 그 때문에 ‘사회’ 또는 ‘사회적’이라는 것에 의문이 제기되기도한다. 이러한 의문을 해명하기 위한 일환에서 이 글은 법, 특히 민사법을 예로 하여사회의 의미가 어떻게 변화했는지 검토한다. 종래 민사법은 공법과는 구별되는 사법으로 사회, 그중에서도 경제체계를 규율하는 법으로 이해되었다. 이때 말하는 사회는 시민을 중심으로 하는 시민사회였다. 이러한 시민사회에서 시민은 자유롭고 형식적으로 평등한 존재로 파악된다. 이에 따라 사회에서 실제로 존재하는 다양한 차이는 배제된다. 민사법은 사회를 이러한 시민사회로 전제함으로써 사회의 자유를 극대화하고자 하였다. 그러나 민사법이 전제로 한 시민사회 기획은 현실에서 한계에 부딪힌다. 이에 이를 보완하고자 새로운 사고모델과 법적 구상이 출현하였다. 사회법은 대표적인 예가된다. 민사법과는 달리 사회법은 사회에 존재하는 차이를 적극적으로 드러낸다. 이외에도 사회구조의 변화는 민사법의 시민사회 구상이 더 이상 유지되기 어렵다는 점을 보여준다. 이 글은 이처럼 근대 민사법이 규율하는 사회 개념은 무엇을 뜻했는지, 이러한 사회 개념이 오늘날 어떻게 변하고 있는지 검토한다. 이를 통해 오늘날 ESG의 맥락에서 강조되는 사회적 기업, 사회적 경제, 사회적 가치 등에 관한 논의에 어떤 의의가 있는지에 유익한 시사점을 획득하고자 한다.

Law is often understood as a system of norms regulating society. However, it is not necessarily clear what the concept of society exactly means in this context. This is because society is not only comprehensive in its meaning, but also pluralistic. Because of this, the meaning of society varies depending on what perspective the concept of society is understood. Because of that, the question of ‘society’ or ‘social’ is sometimes raised. In this context, this article examines how the meaning of society regulated by law has changed, especially the meaning of society regulated by civil law as an example. Traditionally, civil law was understood as a private law that regulates society, especially economic system. The society referred to at that time was a civil society centered on citizens. In this civil society, citizens are identified as free and formally equal persons. Accordingly, various differences that actually exist in society are excluded. Accordingly, civil law tried to maximize the freedom of society by assuming society as such a civil society. However, the civil society project premised on the civil law should encounter some limitations in reality. To respond to this limitations, new thinking models and legal concepts have emerged. Social law is one of examples. Unlike civil law, social law actively reveals the differences that exist in society. In addition, changes in the social structure show that the concept of civil society in civil law is no longer sustainable. This article examines what the social concept regulated by modern civil law meant, and how this social concept is changing today. Through this, it is intended to gain useful implications for discussions on social enterprises, social economy and social values that are emphasized in the context of ESG today.
