불리한 추정이라는 원칙은 영미법에 바탕을 둔 것으로 국제중재절차에서 증거제출을 거부하는 당사자를 상대로 중재판정부가 부과할 수 있는 몇 안되는 제재방법 중 한 가지이다. 영미법과 대륙법의 차이가 점진적으로 좁혀지고 있기는 하나, 불리한 추정의 원칙은 여전히 동아시아에서 상대적으로 낯선 개념이다. 그러다 보니 한국 등 동아시아 기업들은 영미 기업들에 비해 불리한 추정의 원칙에서 열세에 있다고 볼 수 있다. 이 논문은 동아시아 기업 및 법률 실무자들에게 불리한 추정이라는 원칙을 소개하고 조심할 점에 대해 설명하고자 한다. 이 논문은 우선 영미법 및 국제중재에서 불리한 추정 원칙이 어떻게 적용되는지를 요약하고, 이어서 동아시아 실무와 비교한다. 마지막으로 이 논문은 동아시아 소재 독자들에게 불리한 추정의 원칙의 함의를 분석함으로써 끝맺는다. 특히 동아시아 기업들은 자사 내부 문서 보관 규정을 상대방 당사자가 될 가능성이 높은 외국의 소멸시효에 맞출 필요가 있다. 나아가 동아시아의 법률가들도 국제중재절차에서 불리한 추정의 원칙을 무기로써 한결 적극적으로 활용할 필요가 있다.
A transplant from common law jurisdictions, adverse inference is one of the few types of sanctions that arbitrators can impose on parties for refusing to submit evidentiary documents in international arbitration. Yet, despite the increasing harmonization between common and civil law systems, it remains a relatively alien notion to East Asian parties. By virtue of their unfamiliarity with it, East Asian parties involved in an international arbitration are at a disadvantage against parties from common law systems. As such, this Article seeks to inform companies and legal practitioners based in East Asia about the basics and pitfalls of adverse inference. This Article starts out by summarizing how adverse inference is applied under common law and in international arbitration. Next, this Article compares such practice with that of East Asia. Finally, this Article concludes by analyzing the implications of the adverse inference rule for its readers based in East Asia. Most critically, this Article argues that East Asian parties would be wise to update their document retention policies to match the limitation periods of key jurisdictions. At the same time, this Article argues that East Asian practitioners should be encouraged to actively use adverse inference as a weapon in international arbitration.
