현행 국선보조인제도의 한계와 그 개선방안

Limitations and Improvement of the Court-Appointed Assistant System under the Current Act

현행법상 소년보호사건, 가정보호사건, 아동보호사건, 피해아동보호명령사건에서는 행위자 또는 피해아동을 조력하기 위한 보조인제도가 마련되어 있어, 법원은 일정한 경우 국선보조인을 선정(선임)해야 하거나 선정(선임)할 수 있다. 특히 최근 피해아동보호명령사건에서는 피해아동을 위한 국선보조인 선정이 의무화되어 그 중요성이 더욱 강조되고 있다. 이들 중 소년보호사건, 가정보호사건, 아동보호사건에서의 국선보조제도는 헌법 제12조 제4항의 변호인의 조력을 받을 권리와 밀접한 관련이 있다. 비록 국선보조인의 조력을 받을 권리 그 자체를 기본권으로 구성할 수 없을지라도, 이는 행위자의 방어권 행사에 있어 중요한 기능을 한다. 또한 피해아동을 위한 국선보조제도는 피해아동에 대한 국가의 기본권 보호의무를 이행하기 위한 성격을 가지며, 피해아동의 재판절차진술권을 구체화한 제도로 파악할 수 있다. 그러나 국선보조인제도는 역할과 기능의 혼란, 전문성 확보를 위한 교육이나 연수의 부족, 사건별 자격 및 선임 요건의 차이, 규율체계의 혼란, 보수의 열악성 등 많은 문제를 내포하고 있어 대상자의 기본권 보호에 많은 한계를 가지고 있다. 이에 본고에서는 국선보조인의 전문성 제고, 보수체계의 현실화, 처분결정의 기초가 되는자료에 대한 접근권 보장, 국선보조인제도의 활성화를 위한 법률 개정 등의 개선방안을 제시하였다.

The current laws stipulate that in juvenile protection cases, family protection cases, child protection cases, and child victim protection order cases, assistants can be attached for actors or children affected. Therefore, in certain cases, the court must or may appoint a public assistant. In particular, through the recent revision of the law, in the child victim protection order case, the court must appoint a public assistant for the victim if necessary. The court-appointed assistant system is not only closely related to the constitutional right to receive assistance from lawyers, but also has an important function as a system to protect the fundamental rights of victims. However, the court-appointed assistant system has many limitations in protecting fundamental rights, including confusion in roles and functions, lack of education or training to secure expertise, differences in qualifications and appointment requirements for each case, confusion in legal regulations, and low payments. Therefore, this paper proposed improvement measures such as enhancing the professionalism of court-appointed assistants, paying appropriate expenses, ensuring access to data that are the basis of disposition decisions, and revising the law to revitalize the court-appointed assistant system.
