경찰의 무력 사용에 대한 연구

A Study on the Use of Force by Police

경찰은 일반통치권에 근거하여 시민에게 명령·강제함으로써 공공의 안녕한 상태와 질서를 유지한다. 이러한 임무를 달성하기 위한 경찰은 다양한 수단을 사용하는데 이 중 하나가 무력이다. 무력 사용은 다양한 결과를 초래한다. 상황에 따라 적정한 무력 사용은 정당화되고 용인되지만 잘못된 상황판단에 따른 무력 사용은 부정적인 결과를 초래하기도 한다. 따라서 부정적인 결과를 초래하는 경찰의 무력 사용에 대한 연구를 수행하는 것은 경찰의 신뢰는 물론 시민의 생명과 직결되는 문제로 매우 중요한 가치를 가진다. 이에 따라, 본 연구는 선행연구를 중심으로 경찰무력 사용에 대한 몇 가지 큰 범주를 확정하고 관련 연구 결과와 논의를 중심으로 경찰무력 사용에 대해 고찰하고자 한다. 이 연구를 통해 산발적이고 제한된 연구 결과를 종합하여 경찰무력 사용에 대한 유발 요인을 탐색하고 확인하여 부정적 무력 사용에 대한 대응방안을 모색하고자 하였다. 연구 결과, 경찰공무원 개인과 관련한 무력 사용의 부정적 결과가 존재한다는 점과 상황과 환경 그리고 조직간 서로 영향을 미친다는 것을 알 수 있었다. 이에 따라, 개인적 측면과 상황적 측면에서, 경찰의 부정적 무력 사용을 감소시키기 위해 긴급한 상황에서 훈련하도록 하여 긴급한 상황에서도 부정적 결과가 초래되지 않도록 해야 함을 제시하였다. 또한 조직적 문화가 단순히 무력 사용을 장려하기 보다 조건적 상황에서 무력이 사용되어야 함을 제시하였다. 더불어 경찰직무의 환경적 측면에서도 경찰과 시민의 관계가 개선되어야 과도한 무력 사용을 감소시킬 수 있다는 점을 강조하였다.

The police maintain public peace and order by compelling and forcing citizens based on general governance authority. Police use a variety of means to accomplish their mission, one of which is force. The use of force may cause a variety of consequences. Appropriate use of force is justified and tolerated depending on the circumstances, but the use of force based on wrong judgment of the situation can lead to negative consequences. Therefore, conducting research on the use of police force that causes negative consequences is of great importance as a matter directly related to the lives of citizens as well as the trust of the police. In this regard, this study intends to establish several broad categories for the use of police force based on the prior researches, and examine the use of police force focusing on related research results and discussions. Through this study, I have tried to find countermeasures against the negative use of force by exploring and confirming the trigger factors for the use of police force by synthesizing the results of studies that were scattered and limited. As a result of the study, it was found that there are negative consequences of the use of force in relation to individual police officers and also influenced by the situation and environment, as well as the organization and interrelationships. Accordingly, in order to reduce the negative use of police force in terms of personal and situational aspects, it is necessary to train in emergency situations so that negative consequences do not occur even in emergency situations. It was also suggested that force should be used in conditional situations rather than simply encouraging the use of force based on organizational culture. In addition, it was emphasized that excessive use of force can be reduced only when the relationship between police and citizens is improved in the environmental aspect of police task.
