2021년 10월 21일 스토킹 처벌법 시행 이후에 스토킹 범죄에 대한 신고 및 처벌 강화가 이루어지고 있다. 이 연구에서는 국내외 스토킹관련 선행연구를 바탕으로 스토킹범죄 유형의 특징을 실증연구를 통해 분석해보고자 하였다. 2021년 10월 31일 스토킹처벌법 시행 이후를 기준으로 하여 스토킹 사건 판례를 중심으로 스토킹 유형과 관련한 자료를 조사하여 위 선행연구와의 차이가 있는지를 함께 검토하고자 하였다. 강소영(2022)의 스토킹 범죄 행위자의 범죄 동기 유형에 따라 ‘관계요구형’, ‘문제해결형’, ‘분노형’으로 분류하여 각 스토킹 범죄 유형에 따라 스토킹 행위 및 대상자의 특성에 대해 분석하고자 하며, 이를 기초로 하여 스토킹 유형에 따른 대응 및 예방책에 관하여 논의하고자 한다.
