민사법 관점에서의 인공지능 이용행위와 결과물에 대한 소고

A Brief Study on the Acts Using Artificial Intelligence and their Outcomes from a Civil Law Perspective: Based on a technical analysis

2023년에 들어서면서 챗GPT 열풍과 함께 인공지능에 대한 관심도 증폭되고 있다. 인공지능에 관해서는 이미 여러 가지 법적 관점에서 선행 연구가 이루어진 바 있는데, 이 글에서는 선행연구를 간단히 소개하면서, 인공지능을 이용한 행위와 그 결과물에 대한 민사법적 쟁점으로 논의 범위를 한정하여 검토하였다. 이 글에서는 먼저 인공지능의 작동 원리를 기술적 관점에서 살펴봄으로써 인공지능의 실체적 효용과 한계에 대해 명확히 하였다. 그리고 이를 바탕으로 인공지능 기술에서 “자율성”의 의미와 책임론, 인공지능에 상존하는 오류의 가능성과 활용 범위, 불법적 목적을 위한 인공지능의 활용과 책임 등 민사법적 쟁점을 고찰하였다. 인공지능은 인간의 생활 방식을 완전히 변혁할 수 있는 엄청난 기술이지만, 인공지능에 대한 정확한 기술적 이해 없이 과대평가하여 문제점을 과잉해서 도출하여서는 안 된다. 기술에 대한 정확하고 현실적 이해를 바탕으로 법적 리스크나 쟁점을 도출함에 있어 이 글이 미력하나마 기여할 수 있기를 기대해 본다.

As entering 2023, interest in artificial intelligence(“A.I.”) is also amplifying along with the popularity of ChatGPT. There have been various preceding studies from legal perspectives concerning A.I., and in this article, they are briefly introduced. This article aims to limit the scope of discussion to civil law issues related to actions and outcomes involving the use of artificial intelligence. In this article, the practical utility and limitations of A.I. were clarified by examining the operating principle of A.I. from a technical standpoint. Based on this technical understanding, the article reviewed civil legal issues such as the meaning of “autonomy” and responsibility theories in A.I. technology, the potential for errors in AI systems, and the use of AI for illegal purposes. A.I. is certainly a tremendous technology that can completely revolutionize human lifestyles. However, it is essential not to overestimate it without a precise technical understanding, as this may lead to an exaggerated focus on the problems it may present. It is hoped that this article could contribute, to some extent, to the identification of legal risks or issues based on an accurate and realistic understanding of the A.I. technology.
