공공 건설공사에서 경쟁의 공정성을 저해하는 행태가 입찰담합이다. 입찰담합은 참여 자의 균등한 경쟁 기회를 배제한다. 또한 입찰 경쟁의 가치성, 투명성, 그리고 공정성을 훼손하여 기업의 효율성을 저해한다. 공정거래위원회는 KONEPS와 연계하여 입찰담합 을 과학적·체계적인 감시를 위해 입찰상황판을 구축하였다. 이러한 입찰담합 예방 노력 과 다양한 제재에도 불구하고 입찰담합은 근절되지 않고 있다. 본 연구의 목적은 공공 건설공사에서 입찰담합의 유발요인을 고찰하고 입찰담합의 개선방안을 제시하는 것이 다. 개선방안은 다음과 같다: ① KONEPS의 투명성과 공정성에 관한 기준을 재설정한 다. ② 진입제한 장벽이 있는 일괄수주·대안입찰 시장의 참여자를 확대하고 활성화한 다. ③ 불공정하도급으로부터 하수급인 보호를 강화한다. ④ 입찰 경쟁 활성화를 통한 효율성을 높인다. ⑤ 입찰담합 행위에 대한 제재의 실효성을 강화한다. 입찰담합은 예 방 노력과 다양한 제재 수단에도 불구하고 기대수익이 비용을 초과하는 한 경쟁시장에 서 완전한 퇴출을 기대하는 것은 매우 어렵다. 하지만 효율적인 정부 재정 투자와 경쟁 시장에서 공정성 강화를 위해 입찰담합의 예방과 제재 수준의 강화 및 정책적 노력이 필요하다.
The behavior that hinders the fairness of competition in public construction works is bid rigging. Bid rigging shall exclude equal competition opportunities of participants. In addition, it damages the value, transparency, and fairness of bidding, thereby undermining the efficiency of the company. The Fair Trade Commission established a bidding situation table to monitor bid rigging in a scientific and systematic manner in connection with the KONEPS. Despite these efforts to prevent bid rigging and various sanctions, bid rigging has not been eliminated. The purpose of this study is to examine the causes of bid rigging in public construction projects and to propose ways to improve bid rigging. Improvement measures are as follows: ① The standards for transparency and fairness of the KONEPS shall be re-established. ② Participants in a package order or alternative bidding market with barriers to entry restriction shall be expanded and revitalized. ③ The protection of sewage level from unfair subcontracts shall be strengthened. ④ The efficiency through the activation of competition will be enhanced. ⑤ The effectiveness of sanctions against bid rigging activities shall be strengthened. Despite the efforts to prevent bidding and various sanctions, it is very difficult to expect full withdrawal from the competition market as long as expected profit exceeds the cost. However, in order to enhance fairness in the government's financial investment and competition market, it is necessary to prevent bid rigging, strengthen the level of sanctions, and make policy efforts.
