中国高等院校参与法律援助的实现路径研究

Research on the Implementation Path of China’s Higher Education Institutions’ Participation in Legal Aid

《中华人民共和国法律援助法》明确了高校应当在司法行政部门指导下从事法律援助工作，但是却未明确高校参与法律援助的实现路径，而目前高校参与法律援助中普遍存在的管理机制缺位、经费来源缺乏、援助范围受限和激励机制缺乏等问题，严重限制了高校在法律援助中作用的发挥。本文立足于高校参与法律援助的现实状况，从多个方面分析了高校参与法律援助过程中出现问题的原因，对高校更为高效的参与法律援助提出了可行性建议，拟使高校在法律援助中发挥应有作用，为法治建设作出更大贡献。

The Legal Aid Law of the People’s Republic of China stipulates that universities should engage in legal aid work under the guidance of the judicial administrative department, but it does not specify the implementation path for universities to participate in legal aid. Currently, the common issues that exist in the participation of universities in legal aid include lack of management mechanisms, lack of funding sources, limited assistance scope, and lack of incentive mechanisms, which severely limit the role of universities in legal aid. This article focuses on the current situation of universities’ participation in legal aid, analyzing the reasons for problems in the process of universities’ participation in legal aid from multiple perspectives, and proposing feasible suggestions for more efficient participation in legal aid, so as to enable universities to play their due role in legal aid and contribute more to the construction of the rule of law.
