재해로 사망한 공무원의 경제적 손해와 적정 보상에 관한 연구

Comparison of the Survivor`s Benefits in Government Employees Compensation System and the Economic Losses

공무원재해보상제도에서는 공무원이 공무상 재해로 사망한 경우에 있어서의 유족보상급여 지급방법으로 일시금 지급방법인 유족보상금 규정만을 두고 있다. 본 연구에서는 유족보상금 수준의 적정성을 평가하기 위해 재해로 인해 사망한 공무원 측에서 입은 경제적 손해액을 확인하고 이를 공무원재해보상 유족보상금 수준과 비교하여 현행 보상수준의 적정성을 분석하였다. 본 연구의 분석결과에 의하면 경제적 손해액을 제대로 보전해주기 위해서는 유족보상금의 지급기준을 현실화 시켜줄 필요가 있으며, 아울러 유족급여 지급방법으로 연금제도의 도입여부를 적극적으로 검토할 필요가 있는 것으로 분석되었다. 또한 공무원재해보상제도의 개선방안으로 연금지급 방법을 도입하는 경우에는 연령계층별 균형을 고려한 합리적 지급기준의 설계가 필요함을 확인할 수 있었다.

With the Government Employees Compensation System(GECS) in Korea, survivors of the government employees who die of job-related injuries are entitled only to the lump-sum payment. The purpose of this paper is to decide properness of the current survivors` benefits. For this, we first evaluated economic losses incurred to the survivors by the death of the employee and then compared it to the compensation provided by the GECS. The result of this study shows that the current compensation system does not fully account for the economic losses. The adjustment may include payment of annuity in lieu of lump-sum and in this case, it is necessary to check the balance of the compensation among different age groups.
