공공공사에 대한 설계 감리배상책임보험제도의 도입방안

A Study on the Introduction of the Architects and Engineers Liability Insurance System for Public Constructions

본 연구에서는 공공공사 관련 부실설계 및 부실감리를 예방하고 손해배상 수단을 확보하기 위하여 도입된 「설계·감리손해배상보증제도」의 현황 및 문제점을 살펴보고, 보증제도의 개선방안으로서 「설계·감리배상책임보험제도」의 도입방안을 제시한다. 1998년 7월에 도입된 보증제도는 세계적으로 우리나라에서만 시행되고 있는 제도로서 보증제도가 갖는 여러 문제점들로 인하여 본래의 목적을 달성하는데 한계가 있다. 따라서 본 연구에서는 공공공사관련 부실설계 및 부실감리를 보다 효율적으로 예방하고, 더 안정적인 손해배상 수단을 확보하기 위한 대안으로서 보험제도가 활성화될 수 있도록 관련 법령의 개정 등 제도개선 방안을 제시하고자 한다.

This study presents the necessity of introducing the Architects and Engineers Liability Insurance System for public constructions. Because the liability bond system introduced in July of 1998 is very unique and exists only in Korea, it is expected that there will be many problems due to the lack of statistical data, possible conflicts with foreign architects and engineers resulting from mandatory purchase of the unprecedented liability bond, limitation of bond-operating institutions` bond-taking capacity, lack of financial soundness of architects and engineers, possibility of increase in architects and engineers` moral hazards, etc. This study proposes specific operating schemes and accompanying legal and institutional proposals of the architects and engineers liability insurance for public constructions which will be more effective than the bond system to prevent construction-related design and supervision errors and obtain means of paying liability claims arising from public constructions.
