환경오염 리스크관리방안에 관한 연구

A Study on the Risk Management of Environmental Pollution

본 연구는 여러 가지 환경오염원 중 폐기물, 특히 사업장폐기물로 인한 환경오염에 초점을 맞추어 사회전체의 효용을 극대화할 수 있는 사전적·사후적 환경오염 리스크관리방안을 제시하고자 한다. 즉, 폐기물로 인한 환경오염 피해를 사전적으로 최소화할 수 있는 리스크관리방안과 더불어 불가피하게 환경오염이 발생할 경우 신속한 피해복구 및 적정한 피해보상이 이루어질 수 있는 사후적 리스크관리방안도 제시하고자 한다. 구체적으로 현재 입법 중에 있는 『환경오염손해에 대한 배상책임법(안)』의 올바른 입법 방향을 제시한다. 또한 사전적 리스크관리방안으로서 경제적 유인수단인 폐기물예치금 및 폐기물부담금의 개선방안을 제시한다. 사후적 리스크관리방안으로는 「환경오염배상책임보험(Environmental Impairment Liability Insurance; EIL)」의 도입방안 및 환경오염 분쟁조정제도의 개선방안을 제시한다. 지금까지의 다른 연구들과 비교하여 본 연구가 가지는 특징은 환경오염의 예방과 최소화를 위한 사전적 리스크관리방안 및 신속하고 적정한 피해보상을 위한 사후적 리스크관리방안을 유기적으로 연관시켜 종합적인 대책을 제시하고자 하는데 있다.

This study is focused on the environmental pollution caused by hazardous wastes, especially industrial hazardous wastes, and suggests various prior and posterior risk management tools to prevent and/or minimize the adverse effects of these industrial hazardous wastes. Specifically this study proposes the followings; i) the right direction of the proposal of so-called “the Liability Law Regarding Environmental Pollution Losses” which is in the process of legislation in the National Assembly, ii) the modification of the wastes deposit and wastes charge systems as prior risk management tools, iii) the introduction of the Environmental Impairment Liability Insurance(EIL) and the improvement of the environmental disputes settlement system as posterior risk management tools. The distinctive feature of this study compared with other studies which are focused on the introduction of the Environmental Impairment Liability Insurance(EIL), is that this study proposes comprehensive solution regarding the environmental pollution caused by industrial hazardous wastes by combining various prior and posterior risk management tools.
