Research on the Protection and Use of Personal Information: Focusing on the Problem of Excessive Protection

1970년대부터 정보통신 기술의 고도화로 데이터의 생성 처리가 활성화되어 그 이전에는 상상도 할 수 없는 풍요를 누리고 있다. 이와 같은 혁명적 변화가 가능하게 된 것은데이터 처리 기술의 발전과 함께 자유로운 생성, 처리, 이전이 가능하였기 때문이다. 그런데 개인정보보호의 중요성이 강조되면서 개인정보 수집과 처리, 이송에 사전적 동의를 받는 등 엄격한 제한이 가해지기 시작하였고 지속적으로 강화되고 있다. 그런데 개인정보보호를 통한 데이터의 안전한 유통의 고유 목적을 벗어나 자유로운 유통 자체를 방해하는수준에 이르고 있다. 정보사회가 정상적으로 발전하려면 개인정보의 원활한 유통이 필요하다. 정보사회는 정보통신기술이 발전함에 따라 정보 자체가 가치를 가지는 것은 물론, 정보에 의하여 새로운 가치가 창출되기 때문이다. 여기서 정보는 개인정보와 결합 되었을때 비로소 가치를 지닌다. 예를 들어 주식거래, 은행관리, 물건을 사고파는 행위 등을 온라인으로 할 경우에는 개인정보가 필수적으로 필요하다. 그러나 데이터를 적절히 관리 하지 못하면 개인의 사생활이 쉽사리 노출될 수 있고 이로 인해 개인의 자유가 침해되기도하며 상황에 따라 국가안보를 위험에 빠뜨릴 수도 있다는 인식 또한 확산되어 왔다. 그결과 각국에서 개인정보보호제도를 갈수록 강화되고 있다. 따라서 데이터 산업의 발전과개인정보보호의 적절한 균형이 필요하다. 이를 위하여 개인정보 수집과 제 3자에 대한 이전에 과도한 사전적 동의를 축소하고, 가명처리의 활용 범위를 더 넓게 하고, 대안으로서사후적 책임 강화하는 제도적 보완이 필요하다.

Since the 1970s, with the advancement of information and communication technology, the creation and processing of data has been activated, and we are enjoying abundance unimaginable before that. This revolutionary change has been made possible because of the development of data processing technology and the freedom to create, process, and transfer data. However, as the importance of personal information protection is emphasized, prior consent for the collection, processing and transfer of personal information is being strengthened. In addition, it is reaching a level that hinders free distribution itself beyond the purpose of safe distribution of data through personal information protection. In order for the information society to develop normally, the smooth distribution of personal information is necessary. In the information society, as information and communication technology develop, not only information itself has value, but also new value is created by information. Information has value only when combined with personal information. For example, personal information is essential when trading stocks, managing banks, and buying and selling goods online. However, failure to properly manage data can easily expose an individual's privacy, resulting in various side effects. From a balance between the development of the data industry and personal information protection, institutional supplementation is needed to reduce excessive prior consent to personal information collection and transfer to third parties, widen the scope of alias processing, and strengthen post-responsibility as an alternative.
