자유무역협정(FTA)의 투명성 논의와 부패방지 조치

한국이 2003-2021년 체결(서명)한 FTA 21건의 협정문에서 투명성(transparency) 장(章)을 구성하고 있는 협정은 16건이다. FTA의 투명성 장은 당사국이 협정을 명확하게 이행하고 당사국 이해관계인이 상호 인지하고 대응하도록 관련 국내법과 행정절차를 공표하도록 규정한다. 협정의 대상이 되는 사안에 대한 재심과 불복 청구의 행정 집행도 명시하며 협정의 운영에 실질적인 영향을 미칠 수 있는 행정조치에 대한 정보를 상호 제공하도록 규정한다. 투명성 보장의 가장 강력한 ‘부패방지’ 조항은 한-미 FTA와 한-캄보디아 FTA에만 포함되어 있다. 양국이 무역과 투자에서 뇌물수수 및 부패를 근절하기 위해 협력하고 이행 결의를 재확인하는 수준으로 명시되었다. 한-EU FTA에는 ‘비차별’ 조항을 특이하게 부가했다. 한국이 체결한 FTA의 투명성 논의는 부패방지를 위한 최소한의 절차적 조치는 마련한 것으로 평가할 수 있으나 실체적 투명성을 강화하기에는 미흡한 것으로 판단한다. 한국이 주요 교역국들과 FTA를 체결한 이후로도 덤핑행위 또는 보조금 지급의 불공정 무역행위로 제소를 당한 건수와 비중이 증가 추세를 나타낸 것은 FTA의 투명성 조항의 실효적 영향력이 유효하게 작용하지 못하였다고 추론할 수 있다. 자유무역을 촉진하면서 투명성을 실효적으로 강화하기 위해서는 부패방지를 위한 국내 후속조치가 FTA와 연계되어야 한다.

Among the 21 FTA agreements concluded (signed) by Korea between 2003 and 2021, there are 16 agreements that constitute the transparency chapter.
