A Study on the Effect of the Possibility of Establishment of Graveyard Rights on the Auction Price Patio in Court Auction

법원 경매에서 분묘기지권 성립여지 있음이 매각가율에 미치는 영향에 관한 연구의 배경과 목적 및 연구의 범위와 방법으로 법원 경매 법정에서 매각된 물건의 대상으로 평균 매각가율과 연평균 매각가율을 구함을 목적으로 하고, 선행연구에 없는 차별성과 독창성을 추구하였다. 분묘기지권의 이론적 배경과 특성 고찰로 양도형 분묘기지권, 승낙형 분묘기지권, 취득시효형 분묘기지권과 분묘기지권의 범위 및 존속기간, 장사법 시행 전후 설치된 분묘의 인정여부와 분묘기지권에서 지료 지급 의무의 인정여부에 관한 판례를 살펴보았다. 최근 5년간 6개월 단위로 분묘기지권 성립여지 있는 물건 12,311건의 매각가율을 분석하고 분석결과와 시사점 및 연구의 한계를 도출하고, 실전경매 사례 물건을 권리분석 대상으로 살펴보았다. 결론적으로 분묘기지권 성립여지 있는 12,311건의 매각물건들을 감정가 대비 매각가액의 매각가율을 연도별 분석하여 변화의 추이를 파악하고 입찰가액 결정에 도움이 되고자 하였다.

The background and purpose of the study on the impact of the potential establishment of burial rights in court auctions on the auction rate, as well as the scope and methodology of the research, were pursued with the aim of examining the average auction rate and annual average auction rate of items sold in court auction proceedings, which involve the possibility of the establishment of burial rights. The study aimed to offer distinctiveness and originality not present in previous research. Through a theoretical examination of the background and characteristics of burial rights, the study examined different forms of burial rights such as transferable burial rights, acceptance-based burial rights, and acquisition-prescription burial rights. The scope and duration of burial rights, the recognition of burial sites installed before and after the enactment of burial site laws, and case law related to the obligation of providing burial fees within burial rights were explored. Over the recent five years, the study analyzed the auction rates of 12,311 items with potential establishment of burial rights in intervals of six months. The study derived analysis results, implications, and limitations, and investigated practical auction cases as subjects of rights analysis. In conclusion, the study aimed to analyze the trend of auction rates in relation to the appraised value for the 12,311 items with potential establishment of burial rights, on an annual basis, in order to provide assistance in determining bidding amounts and to gain insight into the changes.
