국제마약 수사에서 감청의 활용 필요성

Need for Using Wiretapping for International Narcotics Investigations : Mid to Long-term Review

2021년 국내에 밀반입, 적발된 마약류는 약 1,016.1kg으로 전년 대비 675% 증가, 역대 최고치를 기록하였다. 밀반입량의 대폭적 증가에서 확인할 수 있듯, 국내에 거점을 둔 다수의 국제 마약조직이 활발하게 활동 중이며 이들이 범죄에 동원하는 자금력, 인력이 상당할 것으로 추측된다. 국제 마약조직의 마약 밀반입 및 유통 수법이 점점 정교해지고 있어 기존 수사기법으로 단속 및 검거가 쉽지 않은 상황인바, 현행 통신비밀보호법의 감청 제도를 하나의 대안으로 고려해 볼 수 있다. 해외에서는 감청을 엄격한 사전, 사후 통제하에 범죄 수사에 적극 활용하는 반면, 우리나라는 수사를 위한 감청이 사실상 사문화되어 있어 이를 활용하기 위해서는 법령 정비, 기술적 지원 등 대대적 보완이 필요하고, 사회적 공감대 형성이 선행되어야 할 것으로 보인다. 본 실무 연구에서는 현행 통신비밀보호법의 감청 제도, 활용 현황을 점검하고, 감청 필요성이 확인된 실무 케이스(국제마약 밀반입 조직 수사 사례) 및 해외 감청 법제를 검토, 현행 통신비밀보호법의 감청 제도를 보완·활용할 수 있는 방법을 고민해보기로 한다.

In 2021, narcotics smuggled and detected in Korea amounted to approximately 1,016.1 kg, which was a 675% increase compared to the previous year, thus recording the highest level ever. As evident in the huge increase of smuggled drugs, there are many international narcotics organizations based in Korea that are active, and it is presumed that there is considerable funding and personnel used for these crimes. As the drug smuggling and distribution methods of international narcotics organizations are becoming more and more elaborate, it has become harder to crack down and apprehend the criminals using existing investigation techniques. Therefore, the wiretapping system of the current Protection of Communications Secrets Act can be considered as a solution. While wiretapping is actively used for criminal investigations through strict pre- and post-control abroad, wiretapping is basically nullified in Korea. Thus, massive overhauls such as modifying laws, technical support, etc. are needed, and it will also require the creation of social consensus. In this practical research, the wiretapping systems and utilization status of the current Protection of Communications Secrets Act will be inspected, review of practical cases confirmed to require wiretapping (investigation of international narcotics smuggling organization) and foreign wiretapping laws, while thinking about methods for supplementing and utilizing the wiretapping system of the current Protection of Communications Secrets Act.
