표현의 자유와 국가의 역할 그리고 상호주체성

Freedom of Expression, the Role of the State and Intersubjectivity: A philosophical discussion on freedom of expression and the public sphere

소셜네트워크 확장은 표현의 자유와 그 한계에 대한 새로운 논의를 촉발시켰다. 기술의 발전으로 인해 개인이 자기의 경험과 지식과 생각을 공유할 수 있게 되었고 또한 타인의 의견에 반응하고 소통할 수 있게 되었다. 공론장 논의는 전근대적 사회에서 나타난 폐해를 극복해 줄 이성의 복원을 꿈꾼 기획의 산물이다. 공론장의 형성은 합리화의 역설적 상황을 타개하고 타인과의 소통을 전제로 하고 있다. 또한 표현의 자유에는 분명한 한계가 있다. 포괄적 교리들은 뒤로 하고 이른바 중첩적 합의를 이룰 수 있는 주제를 찾아가려면, 최소한의 의사소통의 규칙을 지켜져야 한다. 공통의 의사소통 규칙은 타인에 대한 존중을 전제로 한다. 공동체 속의 개인의 자율성은 표현의 자유의 보장으로 확보될 수 있으며 이에 대한 국가의 제한은 기본적으로 공적이성의 확대를 위한 보조적인 역할에 머물러야 한다. 왜냐하면 어떠한 것이 가치 있다고 해서 그것을 타인에게 항상 강제해야 하는 것은 아니기 때문이다. 개인의 사상은 타인과의 합의를 전제하며 이질성의 포용을 가질 때 자율성의 신장도 함께 이룩될 것이다. 공론장은 기술의 발전을 통해 새롭게 진화하고 있지만 그렇다고 해서 전통적 의미의 공론장의 중요성이 사라졌다고 볼 수 없다.

The expansion of social networks among individuals has sparked discussions about freedom of expression and its limitations. Due to the development of technology, individuals have been able to share their experiences, knowledge, and thoughts without particular and/or restrictive difficulties. The basis of conversation initiates from comprehension. The public sphere is the product of a great plan through the restoration of reason to overcome the problems of a society that centered only on the pre-modernity. The formation of a public sphere presupposes overcoming the paradoxical situation of rationalization. If we are to leave behind comprehensive dogmatic that we can not compromise on and find topics on which we can achieve ‘overlapping consensus’, we must adhere to minimal rules of communication. Autonomy in a community can be secured by guaranteeing freedom of expression, and the state's restrictions on this should remain in an auxiliary role for the expansion of public reason. What something is valuable doesn't always mean we should enforce it to another. Beyond the belief that freedom of expression is an extension of autonomy through rational resolution of conflicts, we must have the duty to respect others under the value of solidarity.
