일본의 발달장애자지원법에 대한 고찰

A Review Study on Japan's Assistance Act for Developmental Disabilities

이 연구는 일본의 발달장애자지원법의 내용과 시행과정을 고찰하여 현재 입안과정에 있는 우리나라의 발달장애인법(가칭)이 충실한 내용으로 실효성있는 법안으로 성립되는데 필요한 시사점을 제공할 목적으로 시도되었다. 그 결과 다음과 같은 결과를 도출하였다. 첫째, 법안내용의 관련 당사자뿐만 전국민이 공감대를 형성하고, 법안의 주체에 대한 이해와 인식도를 높이는 노력의 전제가 필요하다는 점이다. 둘째, 기존의 법률이 다루지 못하는 부분을 명확히 다루어야 하며, 다른 법률과 중복되거나 유사한 혹은 확대, 제한되는 측면은 심도있는 논의가 필요하다는 점이다. 셋째, 법안성립 이후에는 관련 당사자에게는 법안내용과 시행지침이 상세하게 전달되어야 하고, 시행과정에서는 시행주체간의 긴밀한 협조와 연계가 이루어져야 한다는 점이다.

This study is investigated by Japan's Assistance Act for Developmental Disabilities and the process of implementation, faithful content currently making process in the development of our country with Developmental Disabilities Act (tentatively) concluded by the effective legislation which attempts have been made for the purpose of providing the necessary implications. As a result, the following conclusions are made First, the parties related to the contents of the bill, but I and the formation of a national consensus, efforts are needed to increase awareness and understanding on the subject of the bill. Second, clarify the parts that are not covered by the existing laws of the deal, and are similar or overlap with other laws is limited or expanded, in-depth discussion of the aspects that you need. Third, the legislation established since passed the bill, and performed detailed instructions to the relevant parties to be performed and the close cooperation between the principal and, in the course of implementing the linkage that is made
