2017년 우주로 발사된 발사체 수는 300개였으나 2022년에는 한해 2000개가 넘는 발사체가 우주로 향한 것으로 파악되고 있으며, 2030년에는 고도 2000㎞의 저궤도 내 인공위성 수가 5만7000개가 넘을 것이라는 예측이 나오고 있다. 최근 우주발사체 수량 증가 및 민간기업 참여 등을 고려할 때 국내 우주낙하물로 인한 피해사고는 점차 증가될 것으로 판단되기 때문에 이에 대한 법적 개정은 반드시 필요하다. 이에 본 연구에서는 국내·외에서 발생한 우주 발사체에 의한 낙하물 피해 사례를 통해 지표면에서의 제 3자의 법익 보호와 우주손해배상법 등 각종 법률적용을 분석해 봄으로써 우주안보에 있어 국민의 생명과 재산을 보호하기 위한 발전방향을 제시하였다.
The number of projectiles launched into space in 2017 was 300, but in 2022, more than 2,000 projectiles are believed to be heading into space, and there are predictions that the number of satellites in low orbit at an altitude of 2,000 kilometers will exceed 57,000 by 2030. Given the recent increase in the number of space projectiles and the participation of private companies, legal amendments are essential because the number of damage caused by falling objects in Korea is expected to increase gradually. In this study, various legal applications such as the Space Damage Compensation Act and the protection of legal interests of third parties on the surface were analyzed through cases of falling objects caused by space projectiles at home and abroad, suggesting a direction for development to protect the lives and property of the people in space security.
