재난에 대한 효율적 관리를 위한 지방자치단체의 역할 검토

Review of local governments’ efficient response to disasters

재난안전법은 재난으로부터 국민의 생명·신체·재산을 보호하기 위해 국가와 지방자치단체에 보호 책무를 정하고 있다. 재난은 작은 단위의 지역에서 발생하여 더 큰 단위 등으로 피해를 발생시키거나, 아니면 지역에서 발생하여 많은 지역민들에게 피해를 발생시키는 것을 의미하고 있다. 따라서 재난은 지역에서 발생하여 지역민에게 피해를 발생시키고 있어, 재난에 대한 가장 우선적으로 지역민을 보호하는 기관이 지방자치단체이다. 지방자치단체는 지역주민을 보호할 최일선의 책임기관이다. 이러한 지역주민을 보호하기 위해 지방자치단체는 재난으로부터 지역민을 보호하기 위해 재난에 대한 대응체계 수립을 통하여 안전한 지역사회를 조성할 의무를 가지고 있다. 지방자치단체는 지방자치권을 통하여 지역민을 안전하게 보호할 책무를 가지고 있다. 따라서 재난에 대한 책임기관은 지방자치단체이며, 지방자치단체는 지역의 안전을 통하여 주민의 복리를 증진할 의무를 가지고 있다. 지방자치 실현과 주민안전을 위해서는 재난안전관리에 대한 지방자치단체의 권한과 의무가 확대될 필요가 있다. 주민복리증진이라는 범위 내에서 지역의 안전과 주민의 복리는 지방자치단체가 권한과 의무를 가지고 있다. 그러나 현행 재난안전법은 재난안전에 대한 책임기관을 지방자치단체가 아닌 중앙행정기관으로 이를 규정하고 있다. 따라서 지방자치단체의 자치권 확보와 지역안전권을 위해서는 재난안전법에서 규정하고 있는 재난에 대한 예방·대비·대응·복구 단계에서의 지방자치단체의 권한이 확대되어야 한다. 따라서 본 연구는 재난안전법 상의 예방·대비·대응·복구 단계에서 지역민의 안전을 확보하기 위한 지방자치단체의 역할의 한계를 분석하여 자치권 측면에서 지방자치단체의 역할 확대를 위한 방안을 검토하였다.

The Disaster and Safety Act sets protection responsibilities for the state and local governments to protect the lives, bodies, and property of citizens from disasters. A disaster occurs in a small area and causes damage to a larger unit, or it occurs in a local area and causes damage to many local residents. Therefore, since disasters occur in a region and cause damage to local residents, the local government is the organization that first protects local residents from disasters. Local governments are the frontline responsible organizations for protecting local residents. In order to protect local residents, local governments have the obligation to create a safe community by establishing a disaster response system to protect local residents from disasters. Local governments have the responsibility to safely protect local residents through local autonomy. Therefore, the responsible agency for disasters is the local government, and the local government has the obligation to promote the welfare of residents through local safety. In order to realize local autonomy and ensure resident safety, local governments' authority and obligations regarding disaster and safety management need to be expanded. Within the scope of promoting the welfare of residents, local governments have the authority and responsibility to ensure local safety and the welfare of residents. However, the current Disaster and Safety Act stipulates that the responsible agency for disaster safety is a central administrative agency, not a local government. Therefore, in order to secure the autonomy of local governments and the right to local safety, the authority of local governments in the prevention, preparation, response, and recovery stages of disasters as stipulated in the Disaster and Safety Act must be expanded. Therefore, this study analyzed the limitations of the role of local governments to ensure the safety of local residents in the prevention, preparedness, response, and recovery stages of the Disaster and Safety Act and reviewed ways to expand the role of local governments in terms of autonomy.
