경쟁법집행에서 규제정책의 실태와 쟁점분석

A Study on Regulation Policy in Competition Law Implementation

본 논문은 경쟁법 집행을 통하여 각국의 규제정책 실행 현황을 분석하고 이를 통해 경쟁법집행의 문제점과 쟁점들을 분석해 보고자 하였다. 경쟁법은 정부정책의 효율성과 합리성을 동시에 달성하면서 경쟁과 규제의 상호 딜레마적인 정책상황을 최대한 해결 할 수 있어야 한다. 선진 각국들은 현재 경쟁법의 과대집행과 과소집행의 두가지 오류를 최소화하기 위해 많은 정책들을 병행하여 시행하고 있으나 경쟁법의 국제규범은 아직 만들어지고 있지 않다. 현재 우리나라는 대기업이나 자본 집약적 대규모 산업의 독과점 현상이 사회 문제화 되는 경우가 확대되고 있고 여기에 대한 국민의 일반적인 법 집행 감정이나 정서도 부정적인 이미지와 인식이 크게 작용하고 있어 우리나라의 경우 현행 경쟁법의 과소 집행을 경계해야 한다. 다만, 산업성장의 속도와 기술혁신이 생명인 IT나 환경 및 신재생 에너지 산업 등 신산업등은 산업의 특성이나 국제경쟁력의 확보를 특별히 고려 해야 하고, 또한 전통 산업과 서민밀착형 산업 등에서는 소비자 편익을 강화하는 방향으로 경쟁법 규범이 만들어지고 집행되어야 한다.

This study focus on the regulation policy in the process of competition law implementation accounting for the overregulated standpoint to the large business enterprise. Modern government intervenes actively in the competition market in the large corporation. For this reason, regulation agency meet the mutual dilemma between competition and regulation such as competition law implementation. Therefore, in this study it has been analyzed the reason why the regulation agency strongly intervenes the corporation business affairs especially in Korea. Fundamentally, theses analyzing are focused the competition law norms which explain the competition law has the right direction or not. By and large, the most of countries there are not the competition law norms which is to solve the unfair transaction among the companies. There is no doubt that regulation agency can persue the equlibrium between overregulation and underregulation of competition law. Recently, the large enterprise has the negative images about their industry monopoly as far as we know. The competition law norms should be established to consider the international competition among new industry and IT industry departments. In addition, they will be implemented to consider the consumer’s benefits now than in the past.
