과학기술규제 입법동향 분석

Analysis of legislative trends in science and technology regulation: Focusing on the fin-tech sector

본 연구는 과학기술규제의 입법 현황 및 쟁점을 분석하여 한국의 과학기술 규제 관련 시사점 및 정책제언을 제시하는 것을 목적으로 한다. 구체적으로, 유럽연합(EU), 영국, 한국의 핀테크 분야를 규제완화, 기술혁신지원, 재규제 등 세 가지 차원으로 구분하여 살펴보았다. 분석 결과, 한국에서 핀테크 분야 과학기술규제는 규제완화 및 기술혁신지원 차원뿐 아니라, 재규제 차원에서도 규제 공백이 존재하는 것으로 나타났다. 이러한 규제공백은 핀테크 기업의 금융서비스 진입장벽과 ‘동일기능-동일규제’ 원칙 등과 관련한 논쟁에서 발견할 수 있었다. 결론적으로, 한국적 맥락과 산업적 맥락에서 합리적 수준의 과학기술규제와 그 수준에 대한 심도 있는 사회적 논의가 필요하다는 점을 지적할 수 있다.

The purpose of this study is to provide policy implications and recommendations for the legislation of science and technology regulation in Korea by analyzing and comparing fintech legislation in Korea, the European Union, and the United Kingdom. The findings reveal that there have been regulatory gaps not only in terms of deregulation and support for technological innovation but also in the realm of re-regulation in Korea. In conclusion, a societal discussion and consensus regarding a reasonable level of science and technology regulation within the Korean industrial context are necessary before determining whether the policy direction should lean towards deregulation or re-regulation.
