Improvement Measures for Entitlement to Social Security Benefits for North Korean Defectors’ Households in Crisis

본 연구의 목적은 북한이탈주민 위기가구 사회보장수급권의 법적 실태분석 및 개선 방안 도출이다. 내용분석 방법으로 「북한이탈주민법」을 대상으로 사회보장수급권의 실체적 및 절차적 권리 실태를 분석하였고, 그 분석을 토대로 북한이탈주민 위기가구 사회보장수급권의 개선 방안을 도출하였다. 분석결과, 북한이탈주민 위기가구를 위한 사회보장수급권은 실체적 및 절차적 권리 모두에서 부재하였다. 분석결과는 북한이탈주민 위기가구 사회보장수급권을 보장하기 위한 제도적 개선이 시급함을 시사한다. 「북한이탈주민법」에 ‘북한이탈주민 취약·위기가구’ 정의 신설, 특별지원대상에 ‘취약·위기가구’ 추가, 기본계획에 ‘보호대상자 중 취약·위기상황에 관한 사항’ 신설과 같은 법률 개정, 북한이탈주민 취약·위기가구발굴체계 개선을 위한 발굴대상의 범위 및 발굴주체의 범위 확대, 북한이탈주민 취약·위기가구 보호기간 연장 등을 제안하였다.

The purpose of this study is to analyze the legal status of entitlement to social security benefits for North Korean defectors and derive improvement measures. This study analyze the actual status of substantive and procedural rights of entitlement to social security benefits of 「North Korean Defectors Protection And Settlement Support Act」 using a content analysis method. As a result of the analysis, social security for North Korean defectors’ households in crisis was absent in both substantive and procedural rights. The results of the analysis suggest urgently institutional improvement. Amendment of laws such as establishment of new definition of vulnerable·crisis households, addition of vulnerable·crisis households to special support targets, addition of matters related to vulnerable·crisis situations in protected targets, improvement the excavation system, expansion of the scope of searching targets and subjects, and extension of the protection period.
