제4차 뇌연구촉진기본계획 중 신경윤리학 분야에 대한 비판적 검토

Critical review of the field of Neuroethics in the 4th Brain Research Promotion Basic Plan

의생명과학이 인공지능과 같은 첨단과학기술과 융합한 ‘디지털-바이오’ 의 중추라 할 수 있는 신경과학이 주목받고 있다. 이런 환경변화를 반영해 우리나라 정부는 신경과학의 축적된 연구성과를 실용화·산업화하고, 첨단 과학기술의 빠른 환경변화를 수용하기 위해 ‘제4차 뇌연구촉진기본계획’을 2023년 6월 수립하였다. 신경과학의 밝은 미래 전망과 가시적 성과 창출도 중요한일이지만, 기존 제3차 뇌연구촉진기본계획에서 제시되었던 윤리적, 법률적, 사회적 문제에 대한통합적 연구(신경윤리학)는 기능이 축소되었다는 문제가 있다. 특히, 신경윤리학을 활성화하기위한 법정책적 거버넌스 마련에 대한 기존 내용이 반영되어 있지 않다. 뇌연구 성과 활용을 위한노력도 중요하지만 보다 장기적 관점에서 신경과학의 위험성을 고려하여 예방을 강화하는 것 또한 정부의 역할일 것이다. 이에 본 논문에서는 정부에서 발표한 기본 계획 간의 비교분석과 선행연구 검토를 거쳐서 신경윤리학 활성화를 위한 법정책적 관점에서 제언을 수행하고자 하였다.

Neuroscience, often considered the foundational pillar of “digital bio,” which integrates medical life sciences with cutting-edge technologies such as artificial intelligence, has garnered substantial attention. In response to these evolving circumstances, the Korean government introduced the “4th Basic Plan for the Advancement of Brain Research” in June 2023. This plan aims to leverage and commercialize the accumulated findings of neuroscience while adapting to the rapid changes in advanced science and technology. While the promising future prospects and tangible outcomes of neuroscience are of paramount importance, there exists an issue of diminished emphasis on comprehensive research, particularly in the field of neuroethics, which addresses ethical, legal, and societal concerns, as outlined in the 3rd Basic Plan for the Promotion of Brain Research. Notably, the existing content related to the development of legal and policy frameworks to invigorate neuroethics remains unaddressed. Although efforts to leverage the outcomes of brain research are significant, the government must also play a vital role in reinforcing preventive measures, taking into account the long-term risks associated with neuroscience. Consequently, this paper undertakes the task of presenting recommendations from a legal policy standpoint to revitalize neuroethics through a comparative analysis and a review of prior studies across different governmental basic plans.
