본 연구는 Incoterms® 2020의 가장 큰 변화라 할 수 있는 DPU 조건과 다른 조건에 비해 연구가 부족했던 EXW 조건의 실무적 쟁점과 개선방안을 분석함에 목적이 있다. Incoterms가 개정될 때마다 개정내용에 관한 새로운 연구들이 활발히 제시되고 있다. 하지만, Incoterms® 2020의 DPU에 대해서는 연구의 수가 매우 제한적인 상황이다. 또한, EXW 조건도 다른 조건들의 세부규칙이 보완되며 발전하는 것에 비해 큰 변화가 없고 실무적 사례에 관한 연구도 제한적이다. 두 조건은 연구 빈도에 비해 사고 및 모호한 해석으로 인해 분쟁 가능성이 큰 조건이다. 두 조건의 부족함을 보완하기 위한 타조건 사용 또는 추가적인 실무적 합의를 권장할 수도 있겠지만 궁극적으로는 활발한 연구를 통해 근본적인 개선에 도달하는 것이 합리적인 장기적 방향성일 것으로 생각한다. 이에 본 연구는 두 조건의 실무적 사례, 쟁점 그리고 올바른 사용법을 도출하기 위해 선행연구와 함께 실무자 인터뷰를 병행하였다. 이를 통해, 연구적으로 도출하기 어려웠던 실무적 관점에서 두 조건을 분석할 수 있었다. 이러한 연구는 EXW, DPU 조건에 대한 학문적, 실무적 시사점을 도출할 뿐만 아니라 다른 조건에 관한 새로운 연구 방향성을 제시할 수 있으리라 생각한다.

The purpose of this study is to analyze the practical issues of the DPU condition, which can be said to be the biggest change in Incoterms® 2020, and the EXW condition, which has been understudied compared to other conditions. Every time Incoterms are revised, new studies on the revisions are actively presented. However, the number of studies on the DPU of Incoterms® 2020 is very limited, and the EXW conditions do not change significantly compared to the development of the detailed rules of other conditions, and research on practical These two conditions are conditions with a high possibility of disputes due to accidents and ambiguous interpretations compared to the frequency of research. Although it may be possible to recommend the use of other conditions or additional practical agreements to compensate for the shortcomings of the two conditions, ultimately, I think that reaching fundamental improvements through active research is a reasonable long-term direction. Accordingly, this study conducted interviews with practitioners along with previous research to derive practical cases, issues, and correct use methods for the two conditions. Through this, it was possible to analyze the two conditions from a practical perspective, which was difficult to derive through research. We believe that this study will not only derive academic and practical implications for EXW and DPU conditions, but also suggest new research directions for other conditions.
