스토킹 범죄 분석과 대책에 관한 연구

Research on stalking crime analysis and measures

최근 몇 년 동안 우리 사회에서는 스토킹이 강력범죄로 이어지는 사건들이 늘어나면서 스토킹 범죄의 심각성과 위험성에 대한 사회적 우려가 증가하고 있다. 특히 2020년 9월에 발생한 ‘신당역 스토킹 사건’과 ‘노원구 세 모녀 살인사건’ 등의 사건들은 스토킹이 강력범죄로 이어질 수 있다는 현실을 우리에게 상기시켜 주었다. 이러한 사건들은 스토킹 범죄에 대한 사회적 경각심을 높이게 되었고, 이에 따라 2021년 10월에는「스토킹 처벌 등에 관한 특례법」(약칭 스토킹처벌법)이 시행되었다. 그러나 스토킹처벌법은 여전히 피해자에 대한 보호조치가 미흡하고 스토킹 범죄의 특성에 비추어 보복 우려 등을 막기 어렵다는 한계점이 지적되고 있다. 이를 바탕으로 이 연구는 먼저 스토킹 범죄의 특성에 대한 이해하고자 문헌 자료 검토를 통해 스토킹 범죄의 학술적 정의와 법률적 정의에 대해 알아보았다. 또한, 스토킹 범죄의 국내 발생 현황을 살펴보고 현재의 대응체계의 한계점에 대하여 분석하였다. 따라서 이 연구는 스토킹 범죄에 대한 이해를 바탕으로 현행 제도의 문제점을 파악하고, 피해자 중심의 한계점을인지하고 스토킹 범죄의 가해자에 대한 접근법의 필요성을 강조함으로써 보다 효과적인 대책을 모색하고자 한다.

In recent years, as the number of incidents where stalking leads to violent crimes has increased in our society, social concerns about the seriousness and danger of stalking crimes are increasing. In particular, incidents such as the 'Sindang Station Stalking Case' and the 'Nowon-gu Three Mothers and Daughters Murder' in September 2020 reminded us of the reality that stalking can lead to violent crimes. These incidents raised social awareness about stalking crimes, and accordingly, the「Act on Special Cases concerning Stalking Punishment, etc.」(abbreviated as the Stalking Punishment Act) was implemented in October 2021. However, the Stalking Punishment Act still has limitations in that protective measures for victims are insufficient, and it is difficult to prevent concerns about retaliation in light of the characteristics of the stalking crime. Based on this, this study first investigated the academic and legal definitions of stalking crimes through a review of literature data to understand the characteristics of stalking crimes. In addition, the current status of domestic occurrence of stalking crimes was examined and the limitations of the current response system were analyzed. Therefore, this study aims to find more effective measures by identifying the problems of the current system based on the understanding of stalking crimes, recognizing the victim-centered limitations, and emphasizing the need for an approach to the perpetrators of stalking crimes.
