소방특별사법경찰의 수사에 관한 직무집행능력 향상 방안연구

A Study on ways to Improve the Ability of fire Special Judicial Police to Execute Their Duties Regarding Investigations

본 연구는 소방특별사법경찰을 중심으로 소방행정영역에서 소방법령위반자에 대한 수사주체로써 전문성 확보 수단인 인사 및 채용제도 개선, 통일된 수사전담직제 신설, 교육훈련체계 강화로 수사에 관해 직무집행능력향상방안을 제시하는데 목적이 있다. 연구범위는 소방특별사법경찰의 수사직무 수행과정에서 제기되는 문제점을 개선하기 위한 전문성 확보 수단인 인사 및 채용제도 개선, 통일된 수사전담직제 신설, 교육체계 개선에 한정하였다. 연구방법은 관련 선행연구논문, 소방청 등 통계연보, 미국 등 외국의 운용사례, 정부 각종 보고서, 우리나라 정부부처홈페이지, 언론보도 등을 분석하였다. 연구분석결과 수사직무전담인력은 소수에 불과하고 대부분은 타 직무와 겸직을 하고 있고, 특별사법경찰 수사직제는 과 단위 직제도없이 독립성이 확보하지 못하고 있으며, 전문성 확보를 위한 일선 수사직무수행 소방장 이하에 대한 공채 또는 특채 채용제도가 없을 뿐만 아니라 직무교육을 위한 교육과정개설도 미흡하였다. 결론적으로 소방특별사법경찰수사분야를 신설하여 공채 또는 특채로 채용하는 제도 시행, 현재의 순환보직 인사제도를 지양하고 소방특별사법경찰 직무를 전문분야로 지정하여 직무 연속성과 전문성 확보, 소방특별사법경찰 직무를 담당하는 통일된 직제를 신설하여 소방청과 소방본부에 과 단위 직제와 일선 소방서에 팀 단위 직제 편재 운영, 전문성을 담보할 수 있는 직무교육과정을 개발하여 최소한 6개월 이상의 전문교육을 이수하는 교육제도 도입 등이 조속히 시행되어야 할 것이다.

As a result of the analysis, there are only a very small number of personnel dedicated to investigative work, most of them hold other positions concurrently, the investigative position does not have a division-level structure, so independence is not secured, there is no public recruitment or special recruitment system for fire chiefs or lower to perform front-line investigative work, and no training for job training. Course opening was also insufficient. In conclusion, avoid the new investigative field recruitment or special recruitment system and rotational personnel system, designate the fire and special judicial police duties as a specialized field, ensure job continuity, establish a unified organization, develop a job training course, and complete at least 6 months of professional training. The introduction of an education system should be implemented quickly.
