Throughout the world, the illegitimate's demand for a measure of equality increasingly was being recognized as a basic human right. In1967, a subcommission of the Commission on Human Right of the United Nations adopted a statement on 'General Principles of Equality and Non-Discrimination in Respect of Persons Born out of Wedlock', which demands that 'every person, once his filiation has been established, shall have the same legal status as a person born in wedlock'. This effort on the U.N. reflects active and extensive movements toward reform of the law of illegitimacy that are under way in many countries. To solve the dilemma between protecting illegitimacy and caring legitimate family seems to be in child and family welfare. This study will focus on the legal status of illegitimate children in the Korean Family Law.
