학교 내 성중립화장실 설치의 필요성에 대한 고찰 - 미국 사례의 시사점을 중심으로

이 연구는 미국 사례를 중심으로 학교 내 성중립화장실 설치의 필요성을 살펴보았다. 먼저, 트랜스젠더 학생의 학교에서의 경험이 왜 중요하고 어떻게 영향을 미칠 수 있는지 검토한 후 학생들이 경험하는 차별과 교육 환경에서의 어려움을 검토하였다. 그 후, 학교 안에서 젠더 이분법적 구조를 극복하고 학생들에게 더욱 포용적인 환경을 제공할 수 있는 성중립화장실의 중요성을 강조한 후, 이와 관련된 미국의 사례들을 다루었다. 첫 번째 미국 연방대법원 판결은 근로자에 대한 차별금지 사유 중 하나인 '성별'을 성소수자에 대한 차별금지의 근거로 확장 해석한 대표적인 사례이고, 두 번째 항소법원 판결은 이러한 취지를 학교 내 트랜스젠더 학생에 대한 차별 금지 및 보호까지 확장한 사례이다. 이를 통해 미국 법원은 트랜스젠더 학생에게 자신이 원하는 화장실을 사용할 권리가 있음을 확인하였다. 또한 시카고 공립학교의 자료들을 통해 어떻게 교육당국이 트랜스젠더를 포함한 성소수자 학생들에게 안전한 교육환경을 보장하고 있는지 살펴보았다. 미국 사례의 시사점을 바탕으로 포괄적 차별금지법 제정, 교육법령 개정, 성중립화장실 설치 근거 마련 등 입법적 접근의 필요성을 제시하였고, 교육부를 비롯한 행정부 주도의 적극적 보호 정책 수립과, 마지막으로 사법부의 적극적 법해석 또한 중요함을 주장하였다.

This study examines the necessity for the provision of gender-neutral restrooms in educational establishments. The study begins by examining the significance of transgender students' experiences in school and the ways in which they may be impacted. It then presents a review of the discrimination transgender students encounter and the challenges they confront in educational settings. Subsequently, the necessity of gender-neutral restrooms was emphasized as a means of transcending the constraints of the gender binary in academic settings, thereby fostering a more inclusive atmosphere for students. This was followed by an examination of pertinent cases in the United States. The initial ruling by the US Supreme Court extended anti-discrimination protections for employees on the basis of sex to LGBT individuals. Subsequently, an appellate court ruling extended these protections to transgender students in educational settings. In doing so, the U.S. courts have confirmed that transgender students have the right to use the bathroom of their choice. Additionally, this study examines how Chicago Public Schools is ensuring a safe environment for LGBTQ students, including transgender students. Based on the lessons learned from the US case, it was suggested that a legislative approach is needed, including the enactment of comprehensive anti-discrimination legislation, amendments to the education code, and the establishment of gender-neutral restrooms; the establishment of proactive protection policies by the executive branch, including the Ministry of Education; and finally, the judiciary's active interpretation of the law.
