본 연구는 1996년부터 2024년까지 대법원 판례를 통해 초등 교육당사자들의 권리와 의무 그리고 책임에 대한 법리적 시사점을 분석함으로써, 초등 교육 현장에서 발생하는 법적 갈등에 대한 이해를 높이고자 하였다.주요 발견은 교원의 도덕성과 청렴성이 중요하다는 것, 학교 설립이나 폐교 결정에서 교육 당사자들의 의견을 균형 있게 반영해야 한다는 것, 그리고 교육 환경에서 표현의 자유와 개인의 명예를 잘 조율해야 한다는 것이었다. 또한, 교사의 전문성과 교권을 존중하는 것이 중요하다는 점도 강조되었다. 이러한 분석은 교육당사자들이 자신의 권리와 의무 그리고 책임을 명확히 이해하고 교육 분쟁을 예방할 수 있는 기초 자료로 활용될 수 있을 것이다.
This study examines the legal implications of elementary educational stakeholders' rights, obligations, and responsibilities through an analysis of the Supreme Court Precedents spanning from 1996 to 2024. The primary objective is to deepen understanding of legal conflicts within elementary school contexts. Key findings underscore the significance of educators' ethics and integrity, the necessity for equilibrium among educational stakeholders in decisions regarding school establishment and closure, and the intricate balance between freedom of expression and personal honor within educational environments. Additionally, this analysis brings to the fore education disputes as a central theme, examining how legal conflicts are navigated and resolved in the context of elementary education. The insights gained from this study are intended to provide a foundational framework for educational stakeholders to better understand their legal rights, obligations, and responsibilities, ultimately contributing to the prevention and effective resolution of education disputes in elementary school settings.
