공영방송의 ‘영역의 정의’ 구현 방안 - 보도 진실성과 공정성을 중심으로

Implementing ‘Justice of Sphere’ in the Korean Public Broadcasting Service : Emphasizing Reporting Accuracy and Fairness

본 논문에서는 공영방송이 추구해야 할 가치가 무엇인지를 왈저(Walzer)의 '영역의정의(Sphere of Justice)’ 차원에서 살펴보고, 그간 우리나라 공영방송에서 ‘영역의 정의’ 구현이 미비했던 원인과 그 개선방안을 모색해 보았다. 개선방안과 관련하여 방송법 제4조 제2항 ‘누구든지’의 재해석, ‘방송 공정성’을 노동자 파업의 사유로 인정한 법원의 해석의 문제점, 공영방송사 내 이견조정 시스템 구축, 진실성공정성 구현을 위한 정통 저널리즘 우호 환경 구축 등에 초점을 맞추어 검토하였다. 언론에 대한정치적 후견주의는 그간 우리 공영방송이 사회통합 대신 사회 갈등을 심화시키는 주요인으로 작용했음을 시사한다. 이를 치유하기 위해 저널리즘 영역에서, ‘영역의 정의’가 상이한 정치권은 물론, 정치세력화한 노동조합으로부터의 과도한 간섭을 배제해야 할 필요성이 있다. 이를 위해 방송법 제4조 제2항의 입법 취지에 맞추어, ‘누구든지’의 의미를 외부세력에만 국한하여 해석할 것이 아니라 저널리즘 훼손을 가져올수 있는 내외부 세력으로 확대 해석해야 한다. 사측의 부당 노동행위로부터 노동자를 보호하는 노동법적 가치와, ‘공익’을 지향하는 저널리즘을 추구하는 공영방송은서로 ‘영역의 정의’가 다르므로, 각각 해당 영역의 고유방식으로 보전되고 함양되어야 한다. 이런 점에서, 상황에 따라 고도로 복잡다단한 해석이 수반되어야 하는 ‘방송공정성’을 단순하게 노동자 파업의 사유로 인정한 법원의 해석은 재고의 소지가 있다. 또한, 방송사 내 정통 저널리즘 문화 정착을 위해서, 저널리즘 정신을 구현코자 노력하는 언론인들을 보호하는 법적 장치가 필요하다. 언론인들 간 이견을 조율하는 합리적 메커니즘도 사내에 구축되어야 한다. 정통 저널리즘 문화 정착을 구현하기 위해신입직원 선발 및 직원 연수 시 저널리즘 교육도 보다 강화할 필요가 있다. 성숙한 저널리즘 문화가 정착된다면 방송 보도의 정확성과 공정성 문제는 자연스럽게 사라지게 될 것이고 공영방송의 ‘영역의 정의’ 구현도 가능하게 될 것이다.

Political guardianship of the media has acted as a major factor in intensifying social conflict instead of social integration by Korean public broadcasting. In order to cope with the problem, it is necessary to exclude the excessive influence of trade unions with different ‘justice of sphere’ in the field of journalism. The judiciary must expand the interpretation of ‘anyone’ to include internal and external forces that can damage journalism, in line with the legislative intent of Article 4, Paragraph 2 of the Broadcasting Act. The labor law values t hat protect workers from unfair labor practices by management and the fairness of broadcasting in the field of journalism that pursues the public interest must be preserved and cultivated in each field’s own unique way, as the justice of sphere is different. In this respect, the judiciary’s interpretation of justifying the workers’ strike on the grounds of broadcasting fairness may be subject to reconsideration. A rational mechanism for coordinating disagreements among journalists should also be established within the company. In order to realize the establishment of an authentic journalism culture, it is necessary to further strengthen journalism education when selecting new employees and training staff. If a m ature journalism culture is established, the problem of accuracy and fairness in broadcasting coverage will naturally disappear, and it will be possible to fulfill the ‘justice of sphere’ in the public broadcasting.
