공익사업의 손실보상제도 개선방안 - 피수용자를 중심으로

Improving the loss compensation system for public projects : Focusing on the beneficiaries

본 연구는 손실보상에 대한 여섯 가지 문제점을 선정하여 다음과 같이 개선방안을 제시한 다. 첫째, 토지보상의 개선방안은 보상액 산정의 합리화를 위하여 정당보상의 원칙에 입각한 평등권을 실현할 수 있도록 제도적 장치가 필요하다. 둘째, 축산업 보상규정을 수정 및 보완 하여 영업보상 규정과 다른 제도개선이 필요하다. 셋째, 권리금 손실보상을 명시적으로 규정 하지 않는 토지보상법은 위헌의 소지를 토지보상법을 개정하여 영업손실보상에 권리금 손실 까지 포함시킬 필요가 있다. 넷째, 현재 주거용 건축물의 세입자와 소유자에 대해 차별적인 주거이전비의 지급 문제는 모두에게 동등한 주거이전비를 지급하여 형평성을 확보하는 것이 바람직하다. 다섯째, 이주정착금 지급과 이주대책 사이의 형평성을 유지하기 위해 정기적으로 전국의 이주정착지 조성 비용에 대한 조사가 필요하다. 여섯째, 생활대책의 형평성을 보장하 기 위해, 이주 대상자를 협의계약을 통해 스스로 이주한 자뿐만 아니라 수용재결을 받은 자까 지 포함시키는 것이 필요하다.

This study identifies six issues regarding compensation and proposes improvement measures as follows: Firstly, for land compensation, institutional arrangements are needed to realize the principle of equality based on the principle of just compensation, in order to rationalize compensation calculation. Secondly, revision and supplementation of compensation regulations for livestock farming are necessary, along with other institutional improvements separate from business compensation regulations. Thirdly, the Land Compensation Act, which does not explicitly stipulate compensation for rights fees, needs to be revised to include rights fee losses to avoid potential unconstitutionality. Fourthly, the issue of discriminatory relocation expenses for tenants and owners of residential buildings should be addressed by providing equal relocation expenses to all. Fifthly, to maintain fairness between relocation settlement payments and relocation policies, regular nationwide surveys on the costs of establishing relocation settlements are needed. Lastly, to ensure fairness in livelihood support measures, it is necessary to include not only those who have relocated through consultation agreements but also those who have received acceptance decisions in the relocation target group.
