아동보호 목적에 부합하는 아동학대 초기대응 및 피해자지원에 대한 소고

아동학대에 효과적으로 대응하여 학대를 예방하고 아동을 지원함에 있어 아동학대와 관련된 전 기관이 협력하여 대응하는 것이 목적하는 효과를 얻을 수 있다고 하겠다. 우리의 법제는 일찍이 아동법을 제정하여 아동학대에 대응했던 영국의 그것과 많이 닮아있다고 할 수 있다. 아동에 대한 보호를 전국가적인 목표로 내세우고 이에 대한 구체적인 실행계획을 세우고 관련 법제를 정비하고 특히 아동학대에 관련된 많은 기관들을 서로 유기적으로 협력하게 만드는 체계를 만드는 것은 매우 중요하다고 하겠다. 아동학대전담공무원들과의 면담과정에서도 타기관 특히 아동학대사건처리와 관련된 경찰조직과의 협력에 있어 원활하지 못한 점이 많이 부각되었다. 이것의 원인으로는 정보의 공유 등에 있어 관련 법제가 완비되지 못한 점도 있고 갈등상황을 조정할 상위 기관의 기능이 결여되어 있는 점도 있었다. 아동학대관련 법제에서 기관 간의 협력을 실질적으로 증진할 수 있는 법개정작업이 이루어져야 하겠다. 더불어 아동학대 피해자를 실질적으로 지원하기 위하여 피해자국선변호사제도를 도입하고 있는데, 실제 피해자국선변호사가 아동학대 등에 있어 정보를 획득하는 데에는 법제상의 한계가 존재하는 것을 확인할 수 있었다. 이러한 점도 아동의 건전한 성장과 보호를 위하여 아동이 실질적인 도움을 받을 수 있는 전제조건이 아동과 아동이 처해진 환경에 대한 자세한 정보의 획득에 있다고 할 수 있으므로 이에 대하여 실질적인 권한을 부여하는 방향으로 법개정이 이루어져야 하겠다.

An effective response to child abuse is a coordinated response by all agencies involved in preventing abuse and supporting children. Our legal system is very similar to that of the United Kingdom, which responded to child abuse early on by enacting the Children Act. It is very important to make child protection a nationwide goal and set a specific action plan for it, and to create a system that overhauls the relevant legal system and makes the many organizations involved in child abuse work together organically. The interviews with child abuse officials also highlighted a number of shortcomings in cooperation with other organizations, especially the police, which are involved in handling child abuse cases. The reasons for this include the lack of a complete legal system for information sharing and the lack of a higher authority to mediate conflicts. It is necessary to revise the law to substantially improve cooperation between organizations in the child abuse legal system. In addition, the victim's public defender system is being introduced to provide practical support to victims of child abuse, but it was found that there are limitations in the legal system for victim's public defenders to obtain information on child abuse. In this regard, it can be said that a prerequisite for receiving practical help for the healthy growth and protection of children is to obtain detailed information about the child and the environment in which the child is placed, so the law should be amended to give them practical authority in this regard.
