空间秩序中的两性关系：基于女性主义法学立场的展开

The Gender Relations in Spatial Order: An Exploration from a Feminist Legal Perspective

The traditional perspective of normative analysis of the state of gender relations in the context is usually based on the public and private domains in which the sexes are located. After analyzing the dilemma of the dualistic opposition between public and private, the line analysis path of the combination of public and private dualistic governance is proposed as a corrective scheme. In this way, the gender relationship in the context is actually regarded as a flat, single direction, fixed relationship structure, which is abstract and limited. The legal regulation measures under the influence of this also tend to favor one and lose another. Therefore, this paper tries to introduce spatial order theory to make the situation of gender relations active and concrete. Then, in the analogy analysis between the status of gender intimate relationship and workplace relationship and the non-trait and edge spatial order, a feasible spatial analysis path with overlapping characteristics is explored. At the same time, reflection related norms are applicable to failure and loss in different relational Spaces.

规范对情境中两性关系状态进行分析的传统视角，往往是基于两性所处的公私领域，在剖析公私二元对立的分治困境后，提出公私二元结合共治作为纠正方案的线条式分析路径。如此路径实际上是将情境中的两性关系视为一种扁平化、单一走向、固定的关系架构，很抽象也很局限。受此影响下的法律规制措施也往往顾此失彼。为此，本文试图引入空间秩序理论以使情境中的两性关系状态能动化、具象化。进而在两性亲密关系与职场关系状态同无特质及边缘空间秩序的类比分析中，探寻一条可行的、具有相互交合特性的空间分析路径，并反思相关规范适用于不同关系空间中的失效与迷失。
