The Application of the “Notification - Necessary Measures” Rule for New Network Service Providers

The “notification - necessary measures” rule is an important rule to regulate network infringement. However, with the development of science and technology, new network service providers have some problems in applying the rule. From the perspective of the subject, there are disputes over the application of the law of new network service providers and their duty of care is too heavy; from the perspective of obligations, the scope of necessary measures they should take is not clear. Based on these two aspects, the analysis of the factors affecting the application of the rule mainly includes the influence of the difference of the subject’s technical control ability and the principle of proportionality on the definition of the rationality of the necessary measures’ obligation. In order to improve the application of the “notification - necessary measures” rule for new Internet service providers, measures can be taken: clarify their role as proactive entity reviewers, and introduce “re-notification” into the necessary measures.

作为规制网络侵权重要规则的“通知—必要措施”规则，在适用于新型网络服务提供者事出现了主体与义务面向的双重难题：新型网络服务提供者的法律适用存在争议以及必要措施判定不明确，且其应当采取必要措施义务的范围也不明确。立足主体和义务的逻辑面向，发现影响“通知—必要措施”规则适用的影响因素主要有主体的技术控制能力差异和界定必要措施义务时比例原则适用问题。为优化“通知—必要措施”规则对新型网络服务提供者的适用，应当明确其积极主动的实体审查者的角色定位，同时将“转通知”引入必要措施。
