The French Criminal Policy and Reform in the 19th Century

미셸 푸코가 1975년에 출간한 『감시와 처벌』은 17세기부터 19세기까지 프랑스에서 형벌제도의 변화와 교도소의 탄생 과정을 고찰한다. 푸코의 연구는 학계의 많은 주목을 받았고, 일반 대중들에게서도 큰 관심을 끌었다. 푸코는 형사정책의 역사를 개척한 선구자라고 할 수 있다. 그렇지만 1970년대에 저술된 푸코의 저서는 오늘날 21세기의 시각으로 본다면 근대 프랑스의 형사정책을 온전하게 설명하고 있지는 않다. 애당초 푸코의 연구가 잘못되었다기보다는 그동안 시대가 많이 변화했기 때문이다. 형사정책은 사회와 함께 계속해서 변화하고 진화한다. 오늘날의 형사정책은 1970년대와는 다르며, 이 변화는 과거를 바라보는 우리의 시선에도 영향을 주게 된다. 1970년대에는 볼 수 없었던 것을 지금은 볼 수 있게 된 것이다. 이 논문은 19세기 프랑스의 형사정책을 푸코와는 다른 시각에서 고찰하려고 한다. 푸코의 연구를 비판하거나 부정하려는 것이 아니라 푸코가 볼 수 없었던 것들까지 포괄하여 고찰함으로써 19세기 프랑스의 형사정책을 더 잘 이해하고 나아가 그 시대를 온전하게 파악하는데 도움이 되기 위해서이다.

Michel Foucault’s Surveillance and Punishment(1975) examines the changes of the punishment system and the birth of prisons in France from the 17th to 19th centuries. Foucault can be said to be a pioneer of the study of the history of criminal policy. However, Foucault’s oeuvre written in the 1970s do not fully explain the modern French criminal policy. This is because times have changed a lot. Today’s criminal policy is different from that of the 1970s, and this change also affects our view of the past. What was not seen in the 1970s can now be seen. This paper attempts to examine French criminal policy in the 19th century from a different perspective of Foucault. This is to help better understanding the criminal policy of France in the 19th century and further fully grasp that times.
