현대인들이 다양한 생활습관과 가치관의 차이는 여러 가지 의견을 분출하고삶의 현장에서의 갈등이 예기치 못한 일탈행위로 인한 사안이 증대하고 있다. 우리의 경우 재범이나 형사범의 재범률이 평균 24%에 육박한다는 통계가 바로 그런 삶의 일면을 보여주고 있다. 사회적 일탈을 통해 공동체의 건전한 발전을 저해한다는 것은 누구나 이해하지만 어쩔 수 없는 상황에서의 일탈요소와 우발적 범죄와 조직적 범죄의 유혹이상존한다고 할 수 있다. 빈곤과 사회·경제적 불평등은 높은 범죄율과 관련이 가장 깊다고 할 수 있고합법적인 수단을 통해 얻는 물질적 재화보다 기대이상의 재화를 향한 욕망이 범죄를 유발하는 것으로 볼 수 있다. 또한 교육 및 기회의 부족으로 인한 불평등적인 요소가 개인의 기술이나 수단이 부족한 사람들과 약물의 남용 및 중독으로 인한 범죄의 요소가 현대인들에게 많은 영향을 주는 것과 사회적 흐름과 연관되어 생각할 때 범죄와 재범의 주요요인으로 작용한다는 것도 부인하기 어렵다. 특별히 역기능적인 가정환경이나 어린 시절의 트리우마와 방치에 가까운 환경및 학대는 반사회적인 행위를 유발하기 쉬운 요소이고 개인의 정신적인 문제와대인관계에서의 어려움이 재범을 높이는 것으로 나타났다. 범죄를 이해하는 문화적 규범이나 태도 및 사회적 인식과 도덕적 가치와 공감대의 부족으로 인한 타인의 권리와 안녕을 간과하는 행위 속에 후회나 죄책감을무시하는 것과 인간성의 결여는 범죄의 요소가 나타나는 결정적인 것으로 고려할 수가 있다. 범죄 행위에 대한 일률적인 패러다임을 규명하기 위한 제도적인 방안과 함께사회적 공동의식과 공동선을 향한 대안과 사회의 의미 있는 변화를 통해 범죄율을 줄이기 위한 형사조정제도가 시행중에 있다. 이를 토대로 효율적인 시행의 필요성이 절감하는 가운데 사회적·경제적·심리적· 체계적 요인을 포괄하는 다각적인 접근 방식의 하나로 급부상하는 회복적사법의도입이 왜 필요한가에 대한 이해와 역할을 피력하고 재범률이 지금보다는 더욱낮아져야 한다는 명제 속에 회복적 사법의 역할과 기대를 살펴본다.

In particular, Counter-donative family environment, childhood trauma, an environment close to neglect, and abuse are factors that can easily cause antisocial behavior, and individual mental problems and difficulties in interpersonal relationships have been shown to increase recidivism. Ignoring regret or guilt and lack of humanity in the act of overlooking the rights and well-being of others due to lack of cultural norms or attitudes, social awareness, moral values, and lack of empathy for understanding crime can be considered as decisive factors in the appearance of elements of crime. there is. In addition to institutional measures to identify a uniform paradigm for criminal behavior, a criminal adjustment system is being implemented to reduce crime rates through social common consciousness, alternatives toward the common good, and meaningful changes in society. In support of this and the need for efficient implementation, the understanding and role of why the introduction of restorative justice, which is rapidly emerging as a multifaceted approach encompassing social, economic, psychological, and systemic factors is necessary, was expressed, and the recidivism rate was lowered than it is now. We examine the role and expectations of restorative justice under the proposition that it must be lowered further.
