할랄산업 지원정책에 관한 법적 고찰

A Review on the Legal Issues of the Promotion of Halal Industry

오늘날 이슬람 국가에 진출하거나 자국으로 유입된 무슬림을 상대로 사업을 영위하기 위한 관건으로 할랄인증이 중요한 관심사가 되고 있다. 할랄산업 지원정책은 일차적으로 외국 무슬림으로부터 돈을 벌겠다는 경제적 관점에서 비롯하였다. 그러나 할랄산업 지원정책은 종교적 관점과 법적 관점으로도 살펴볼 수 있어야 한다. 개인 기업 차원에서 할랄산업을 경영하는 것과는 달리, 국가나 지방자치단체가 할랄인증을 지원하고 할랄산업을 적극 추진하는 것은 국교분리원칙에 따른 종교적 중립성을 저해한다. 할랄인증에 따라 이슬람 방식으로 운영되는 도축장 근처에 있는 양돈업자나 돼지 도축업자는 재산권과 영업의 자유를 침해받을 가능성이 매우 크다. 또한 할랄인증을 받은 기업에 종사하는 비무슬림의 경우 종교의 자유와 직업의 자유를 침해당할 가능성이 크다. 외국인 무슬림의 종교의 자유를 위해 한국인의 종교의 자유가 침해당하는 셈이 된다. 한국에 할랄산업이 활성화되어 무슬림 유입 등으로 무슬림 세력이 커질 경우, 무슬림 게토가 형성됨으로써 한국 법체계의 통일성과 정치적 공동체로서의 동질성이 위협받을 수 있다. 따라서 한국 사회의 안정성을 확보하기 위하여 영주권자의 지방선거권과 한국 이민정책의 방향을 신중히 따져보아야 한다. 현재와 같이 영주권자에게 지방선거권을 부여하려면 국내 의무 체류 기간을 요건으로 두어야 할 것이다. 또한 한국에 이주할 사람은 한국 헌법의 기본적 가치체계를 존중하여야 할 것이다. 그러한 점에서 한국 이민정책은 신중하게 전개되어야 한다. 법적 문제는 사후에 닥쳐서 해결하는 것보다 그 문제점을 예상하고 적절한 대비책을 세우는 것이 지혜롭다. 사후 해결에 따른 비용 차원의 문제만이 아니라, 한번 형성된 경로는 바로잡기가 대단히 힘들기 때문이다. 한국에서 할랄인증 내지 할랄산업을 둘러싼 법적 문제는 점진적으로 나타날 것이다. 따라서 이를 미리 뚜렷하게 보는 혜안과 그 문제를 미리 대비하는 지혜가 필요하다.

Today, halal certification has become an important concern for those who are expanding into Islamic countries or doing business with Muslims who visit their country. The halal industry support policy was primarily started from the economic perspective of making money from foreign Muslims. However, the halal industry support policy must also be viewed from religious and legal perspectives. Unlike running a halal industry at the individual company level, the support of halal certification and the active promotion of the halal industry by the national and local governments will hinder religious neutrality under the principle of separation of religion and state. Pig farmers and pig slaughterers near slaughterhouses operated in an Islamic manner due to halal certification are highly likely to have their property rights and freedom of business violated. In addition, non-Muslims who work at halal-certified companies are highly likely to have their religious freedom and freedom of occupation violated. The religious freedom of Koreans will be violated for the sake of the religious freedom of foreign Muslims. If the halal industry is highly promoted in Korea and the influence of Muslims increases due to the influx of Muslims, the unity of Korea's legal system and homogeneity as a political community may be threatened as Muslim ghettos are formed. Therefore, in order to ensure the stability of Korean society, it is necessary to carefully consider the local voting rights of permanent residents and the direction of Korean immigration policy. To grant local voting rights to permanent residents as is the case now, a mandatory stay period in the country would be a requirement. In addition, people who immigrate to Korea would have to respect the basic value system of the Korean Constitution. Therefore, Korean immigration policy must be developed carefully. It is wiser to predict problems and take appropriate measures rather than facing and resolving legal issues after the fact. Legal issues surrounding halal certification and the halal industry in Korea will gradually emerge. Therefore, it is important to have the eyes to see this clearly and the wisdom to prepare for the problems in advance.
